Income Support (Amendment No. 13) (Jersey) Regulations 201-

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister decided to lodge ‘au Greffe’ the Income Support (Amendment No.13) (Jersey) Regulations 201-

Reason(s) for Decision:

Income Support legislation requires the Minister for Social Security to bring forward any proposals to changes to the rates of components of Income Support for consideration by the States Assembly.  The majority of component rates were last reviewed on 1 October 2013 (P.66 / 2013) and this proposition sets out proposals to amend selected component rates from 1 October 2014.

 

The proposed Regulations allow for the Personal Care, Mobility and Clinical Cost elements of the impairment component to be increased in line with the March 2014 RPI of 1.7%.  In addition the Carer’s Component is also to be increased by 1.7%.

The Regulations also make an increase of the value of the child day care component rates of 5.1%, which is in line with recent  increases  agreed between the Education, Sport and Culture Department and childcare providers in respect of the Nursery Education Fund (NEF). The Minister is keen that the increase to the Income Support component reflects the increase in prices of childcare over the last two years.

Resource Implications: There are no manpower implications for these changes.

The total cost for the 1.7% uprate to impairment/carer components is expected to be £139,000

The total cost for the 5.1% uprate to the child day care component is expected to be £46,800

Therefore the combined cost of 5.1% childcare uprate and 1.7% impairment/carer uprate will be approximately £185,000.

Action required: Policy Principal to request the Greffier of the States to arrange to lodge ‘au Greffe’ the draft legislation and to request a States debate on 15 July 2014.
