St. James School, Chapel Lane, St. Helier: Alterations: Tender and Drawings Approval

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: St James School - Approval of Drawings and Acceptance of Tender for Internal Remodelling and Disabled Access Ramp.

(RC 0118-01-001)

Decision(s):

 

(a)  In accordance with paragraph 1 (d) of Standing Order 168, the Assistant Minister, under delegated authority, approved drawings and specifications numbered:

10361/101; 10440/02 and 10361/102A.

- all showing the proposed works to St James School, Chapel Lane, St Helier.

 

(b)  The Assistant Minister agreed to accept the lowest fixed price tender submitted by AC Mauger Construction Ltd in the sum of £274,302.00 to St James School; and enter into a formal JCT Minor Works Contract.

 

Reason(s) for Decision:

 

The drawings noted in item (a) above and which bye-law approval have been granted (Permit B/2012/0614 refers) reflect the use for which the funding is provided.

 

Under Standing Order 168 (1) (d), it is a requirement for the Minister for Treasury and Resources to approve plans for the construction (or alteration) of buildings where the work is to be funded wholly or partly by money voted by the States.

 

The estimated total cost for the works at St James School (including the lowest tender received, professional fees and ‘other’ costs), as designed, can be completed within the currently allocated capital budget.

 

The lowest fixed price tender submitted by AC Mauger Construction Ltd. in the sum of £274,302.00 can be accepted and a contract entered into.

 

Resource Implications:

 

Other than those noted in the report, there are no further financial or manpower implications.

 

Action required:

 

The Director, Jersey Property Holdings to sign the contract and any other associated documentation under existing scheme of delegation.
