Overdale Hospital - land parcel, St. Helier: Sale to Jersey Electricity Company Limited:

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Report Title: Relocation of Overdale Hospital Jersey Electricity Company Substation 303 and installation of a metered RMU for the new  hospital site, Westmount Road, St. Helier – Land Sale

Exempt (Article 33(b))

Decision(s):

As provided under Standing Order 168 (1) (a), the Minister decided to approve the sale of a parcel of land to the Jersey Electricity Company (JEC) in accordance with the agreed Terms, and for the sale contract to be passed through the Royal Court as detailed in the accompanying report.

Reason for Decision(s):

The Minister for Infrastructure, on behalf of the Public of the Island of Jersey, approved the sale of a parcel of land located adjacent to Westmount Road. The land is intended for the relocation of JEC Sub-Station 303 and the installation of a metered Ring Main Unit to serve the new hospital site at Westmount Road, St. Helier.  In addition to the sale of land, there will also be a cession and transfer of associated cable wayleave rights by the Public to JE Route.   As part of the construction of the proposed new hospital, including associated external facilities, parking, and landscaping, and to support the property once completed, it is necessary to relocate and situate the sub-station on-site.  Terms have been agreed with JEC for the sale of the sub-station site on contract terms consistent with other JEC sub-stations in the Island.

Resource Implications: There are new financial and/or staffing implications. Further detail is included in the detail section of the report.

 

Action Required: The Minister hereby authorised, as applicable:  1. under Standing Order 168 (5) the Attorney General and the Greffier to pass any contract which is required to be passed on behalf of the Public. After the expiry of 15 working days following presentation to the States the transaction may be concluded.  2. The Director of Jersey Property Holdings to conclude any contract which is required to be concluded on behalf of the Public.
