Medium Term Financial Plan 2017 – 2019: Amendment to Funding for Fee-Paying Schools

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: To reduce the Age Weighted Pupil Unit (AWPU) States funding payable to fee-paying schools by 1.5% in 2018 and by a further 1.5% in 2019. This is with reference to the States Act dated 30th September 2016, in which approval in principle was granted to minor adjustments to subsidies for both States and private fee-paying schools, as set out in appendix 1 of the Medium Term Financial Plan Addition for 2017-19 (P.68/2016) (as amended); and with reference to the States Act dated 14th June 2011, in which the States agreed that changes to the financial arrangements for such schools should be the subject of a separate States proposition before implementation.

Decision(s): The Minister decided to lodge ‘au Greffe’ a proposition seeking the agreement of the States to reduce the Age Weighted Pupil Unit (AWPU) States funding payable to private fee-paying schools and States fee-paying schools by 1.5% in 2018 and by a further 1.5% in 2019.

Reason(s) for Decision: The States Assembly approved the Medium Term Financial Plan proposals, which included a user pays charge described in the documentation as ‘minor adjustments to subsidies to fee-paying schools’.

 

This proposal would alter the funding formula for the States contribution to fee-paying schools in the public and private sector (Victoria College, Victoria College Prep, Jersey College for Girls, Jersey College Prep, Beaulieu, De La Salle and FCJ Primary School). The change will be phased in over two years, beginning in 2018.

 

As a result of changing the base funding formula, a recurring saving of £600,000 will be achieved from 2019.

Resource Implications: Approval of this proposition will enable the Education Department to meet its savings target. If this is rejected, other equivalent savings will have to be found within the Education Department budget.

 

There are no staffing implications because all the necessary work will be conducted within existing teams.

Action required: The Greffier of the States to be requested to arrange for the proposition to be lodged ‘au Greffe’ for consideration by the States Assembly at the earliest possible date.
