Jersey Airport, 1937 Arrivals Building: Acceptance of tender for part demolition

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Acceptance of Tender for the part demolition of Jersey Airport, 1937 Arrivals Building.

 

 

Decision(s):

  1. To accept the tender submitted by A C Mauger as detailed in the attached report for the main contractor role for the demolition of the old air traffic control centre, Jersey Airport.

 

 

Reason(s) for decision:

 

Following the completion of the new Air Traffic Control Centre, the Airport has an undertaking with the CAA to reduce the height of the existing Arrivals Building.

 

Regulatory Compliance with CAP 168 dictates that the top two floors must be reduced because they impinge upon the 1:7 Transitional Surface.

Furthermore, line of sight from the new ATC Tower VCR to the taxi way near stand 1 is now impacted.

 

Capital funds have already been approved for the demolition and remedial works under decision TR-2011-DD34 and Treasury have indicated approval in principle to the transfer of the additional funds pending Ministerial approval of the decision. The budget is contained within Business Unit VY1004.

 

The drawings for the works were approved under the Planning Permit P2010/0401 and Building Permit B2010/0233 have already been approved by the Minister of Treasury and Resources under 1 (d) of Standing Order 168, whereby the Minister of Treasury and Resources has approved “plans for the construction or alterations of buildings where the work is to be funded wholly or partly by money voted by the States”.

 

Action required:

 

1)      To accept the submitted tender by A C Mauger and delegate the Airport Operations Director of Jersey Airport to conclude the final contract arrangements within the available approved budget.
