Mont Orgueil Castle, St. Martin, and Les Gellettes, St. Lawrence, - archaeological evaluation

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

1.     The Minister authorised the proposed archaeological evaluation at Mont Orgueil Castle, St Martin on the basis of the detailed project design for the work which has been endorsed by the Minister’s consultant archaeological adviser and the Principal Historic Environment Officer, and on the basis that support for the proposed works has been expressed by a range of heritage groups and stakeholders;

2.     The Minister also noted and endorsed the proposed archaeological evaluation at Les Gellettes, St Lawrence, on the basis of the detailed project design for the work which has been endorsed by the Minister’s consultant archaeological adviser and the Principal Historic Environment Officer, and on the basis that support for the proposed works has been expressed by a range of heritage groups and stakeholders.

Reason(s) for Decision:

1     The assessment and approval of the detailed project design, which will govern the methodology and implementation of the proposed archaeological evaluation at Mont Orgueil, St Martin enables the Minister to regulate and authorise the proposed works at this site;

2     The assessment and approval of the detailed project design, which will govern the methodology and implementation of the proposed archaeological evaluation at Les Gellettes, St Lawrence enables the Minister to note and endorse the proposed works at this site;

3     The proposed works have been endorsed by the Minister’s professional advisers as well as a range of heritage groups and stakeholders including;

a)     at Mont Orgueil - Société Jersiaise; Council for the Protection of Jersey’s Heritage; National Trust for Jersey; Save Jersey’s Heritage; Channel Islands Occupation Society; and Mr Michael Green

b)     at Les Gellettes - Société Jersiaise; Council for the Protection of Jersey’s Heritage; Save Jersey’s Heritage; Jersey War Tunnels; Holocaust Memorial Day Committee; and Channel Islands Occupation Society.

Legal and Resource Implications:

1.     Article 54(2) of the Planning and Building (Jersey) Law 2002 provides the Minister with authority to grant permission for operations not amounting to development where they affect the special interest of a Site of Special Interest;

2.     Mont Orgueil Castle, St Martin is Listed as a Site of Special Interest; Les Gellettes, St Lawrence is a proposed Site of Special Interest;

3.     The form of application for permission, where it affects the special interest of a Site of Special Interest, is not prescribed.
