Budget transfer from Central Planning Vote to Education, Sport and Culture (ESC) to fund a public consultation on possible sites for Les Quennevais School replacement

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Central Planning Vote (CPV) allocation to Education, Sport and Culture (ESC) to fund a public consultation on possible sites for a replacement school at Les Quennevais

Decision(s): 

The Minister for ESC requested that the Minister for Treasury and Resources approve a budget transfer of £25,000 in 2015 from the Central Planning Vote to ESC to fund a public consultation on possible sites for a replacement school at Les Quennevais.  

Reason(s) for Decision:  

Funds are required to enable the public consultation to proceed, and these will be used to pay for the costs of publications, room hire etc

Resource Implications:  

The Les Quennevais School capital project is in the States forward capital programme, and this is subject to approval by the States of the Medium Term Financial Plan 2016-2019. The funding of £25,000 is needed in the short term, prior to States consideration of the Medium Term Financial Plan, to enable arrangements to be made for the public consultation to proceed during the autumn of 2015.

 

As a result of this decision, the ESC capital head of expenditure will increase by £25,000 in 2015, with the Central Planning Vote decreasing by an identical amount. This decision does not change the total amount of expenditure that would be approved by the States for the Les Quennevais capital project, and upon approval by the States Assembly of the capital project the amount received will be transferred back to the CPV from the Les Quennevais Head of Expenditure from JPH. If, however, the States should decide not to approve the capital project, then it would be the responsibility of ESC to repay the CPV from alternative sources of funding,

Action required:  

The Finance Director to seek approval from the Minister for Treasury and Resources and then to action the budget transfer.
