A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Recommendation

That the decision be reconsidered and approval be granted subject to the following conditions:

This permit grants approval for the replacement of six modern timber windows and two doors on the west facing elevation of the dwelling only with upvc. The windows shall be 2 pane vertical sliding sash to match the existing upvc window on this elevation which was approved in 2006. Permission is not granted for the replacement of any of the timber window or door openings on the east (courtyard) facing elevation of the property.

Reason: Further alteration of any of the timber frames or doorways on the east facing elevation would be damaging to the historical nature of the property and therefore contrary to Policy G3(iii) of the Jersey Island Plan 2002.

 

Comments on Case

The dwelling forms part of a courtyard complex, all in the same ownership, with the dwelling, which was a former barn, on the western side and a barn which remains untouched on the eastern side. A single storey element, alterations to which were approved in 1988, with upvc windows and doors, is to the southern end.

None of this is Registered but it clearly pre-dates 1920.

Permission was granted in 2006 (RW/2006/01585) for the replacement of an aluminium window frame on the gable end with upvc and for two timber windows, one to the west and one to the east of the dwelling with upvc. This permission has been implemented.

Permission was refused in July 2007 for the replacement of 6 ground floor windows and two doors on the west elevation with upvc. These are all currently timber and are in a poor state of repair. They are not visible from any public vantage point and were inserted into the building when it was converted from a barn in 1973. The style of upvc window chosen is a 2 pane vertical sliding sash of good quality and appearance.

On the east facing elevation (courtyard side) permission was also refused to replace three windows and one door with upvc. These are all timber and are in a good state of repair.

In this instance it is considered that it would be unreasonable to disallow the replacement of relatively modern frames in what are new openings on the west facing elevation of the dwelling. Additionally these cannot be seen from the road.

The courtyard side of the property is worthy of more protection, and some of these openings could well be original although the frames are not. One window on this side of the house, and all of the windows in the single storey section of the house are already upvc but more should be resisted in the interests of preserving the appearance of the courtyard.

The applicants supporting letter is attached. It states that if the proposal for replacement windows was acceptable last year why has this one been rejected.

 

 

Recommendation

That permission be granted for the insertion of upvc windows and door on the west facing elevation of the dwelling but permission be refused for any further upvc windows or doors on the courtyard elevation subject to the condition suggested above.
