Ro-Ro Ramp No. 5 and St. Helier Marina Phase 1 Works: Capital Heads of Expenditure: Merger

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Merger of Capital Heads of Expenditure to support No 5 Ro Ro Removal and St Helier Marina Phase 1 Works

 

Decision(s):

1)      The Assistant Minister requested the Minister for Treasury and Resources to approve the merger of capital head of expenditure XY1110 RoRo No 5 Access Ramp with a budget of £300,000 into XY1004 with a budget of £1,810,000 to create on head of expenditure XY1004 with a budget of £2,110,000.

 

2)      The Assistant Minister approved the release of 15% of the Project Budget to allow the detailed engineering design phase and tender compilation to be completed, and the purchase orders to Marina Projects and Arup for the project management and detailed engineering design phase to proceed.

 

Reason(s) for Decision: 

1)      The approval of the Minister for Treasury and Resources is required to merge capital heads of expenditure.

 

2)      Access to Berths 4 and 5 is provided by an old RoRo Ramp which is now at the end of its serviceable life and has effectively been decommissioned and currently limited to pedestrian and light vehicle use. Following recent observations and concerns, engineer’s inspections have confirmed the RoRo Ramp to be in poor condition and early action is necessary.

 

3)      Temporary remedial repairs have been conducted on the St Helier Marina wall following structural failings at the end of 2012. A permanent repair is required.

 

Resource Implications:

1)      The merger will not impact on the overall Harbours capital expenditure.

2)      £317,000 will be released from XY1004 (15% estimated project cost)

 

Action required:

For the Group Infrastructure Director to:

 

  1. Request the Minister for Treasury and Resources to approve the merge of the two capital heads of expenditure (XY1110 into XY1004) and create one budget in XY1004 totalling £2,110,000

 

  1. Release of £317,000 (15% Project Budget) to allow the detailed design phase and tender compilation to be completed.

 

  1. Issue of purchase orders to Marina Projects and Arup for the detailed engineering design phase to proceed
