Budget Transfer: CSR Savings / Insurance

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:

Approval of a non-recurring budget transfer in 2012 for corporate procurement project savings identified by the Treasury & Resources Department and agreed by the Health & Social Services Department.

 

Decision(s):

The Minister approved a non recurrent budget transfer of £86,120 from the Health & Social Services Department to the Restructuring provision for agreed CSR savings within the department of £25,710 and a reduction in the annual recharge from the Treasury & Resources Department for non-medical insurance of £60,410.  Budget has been removed recurrently through the Medium Term Financial Plan.

 

Reason(s) for Decision:

 Article 2(6) of the Public Finances (Transitional Arrangements) (Jersey) Order 2011 states that all or any part of the amount appropriated by a head of expenditure may, with the approval of the Minister for Treasury and Resources, be used for the purposes of another head of expenditure.

 

Section 5.1 of Financial Direction 3.6 also states that Departments wanting to transfer funds between heads of expenditure must obtain the approval of their minister or of their accounting officer where a scheme of delegation exists.

 

Resource Implications:

The Health & Social Services Department’s revenue head of expenditure to decrease non recurrently by £86,120 and the Restructuring provision to increase by an identical amount. 

 

Action required:

  1. The Treasury & Resources department seek the approval of the Minister for Treasury & Resources to accept the budget transfer.
  2. The Treasury & Resources department transfer £86,120 non recurrently in 2012 from the Health & Social Services revenue head of expenditure to the Treasury & Resources department Restructuring provision head of expenditure.
