Treasurer of the States / Treasury Accounting Officer: Interim Appointment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: The interim appointment of Richard Bell to carry out the functions of the office of Treasurer.

Decision(s): The Minister decided:

  • to appoint Mr Richard Bell to the position of Interim Treasurer to carry out the functions of the office of Treasurer until a new Treasurer is appointed. The appointment of Mr Richard Bell is effective from 11th August 2014.
  • To appoint Richard Bell as Interim Accounting Officer for the Treasury and Resources Department and those special and trust funds for which Ms Rowley had Accounting Officer responsibility. 

Reason(s) for Decision: The Public Finances (Jersey) Law 2005 establishes the office of Treasurer, Article 29 (5) (a) of the law allows the Minister to appoint a person to carry out the functions of the office of Treasurer whilst the office is vacant.   The Law also covers the requirement for Accounting Officer appointments.

 

Following the resignation of Ms Laura Rowley, Mr Richard Bell has been appointed Interim Treasurer, effective from 11th August 2014, to fulfil the functions of the office of Treasurer until a permanent replacement is appointed.

Resource Implications: There are no manpower or resource implications.

Action required: Mr Richard Bell to carry out the functions of the office of Treasurer for the period the office is vacant and to be appointed as Accounting Officer for the Treasury and Resources department and associated special and trust funds.

Appointment of Interim Treasurer

 

 

  1. Purpose of Report

The interim appointment of Richard Bell to carry out the functions of the office of Treasurer and to take on the role of Accounting Officer for the Treasury and Resources Department and the special and trust funds for which Ms Rowley previously had Accounting Officer responsibility.

 

 

  1. Background

Laura Rowley, the Treasurer of the States resigned from her post effective from 11th August 2014. Mr Richard Bell has been appointed Interim Treasurer to fulfil the functions of the office of Treasurer until a permanent replacement is appointed.

 

 

  1. Current situation

The office of Treasurer shall be held by a person appointed by the Minister after consulting the Chief Minister. Under Article 29(5) (a) the Public Finances (Jersey) Law, 2005 (the Law) provides for an interim appointment in order to ensure that the functions of the office are properly fulfilled. Mr Richard Bell has extensive experience having held Chief Officer role at Social Security and previously served as Deputy Treasurer and is able to perform the function of Treasurer in an interim capacity until a new Treasurer can be appointed.

 

Articles 37 and 38 of the Law deal with the role of Accounting Officer, the Minister for Treasury and Resources is asked to confirm that Richard Bell take over Accounting Officer responsibilities for those areas held by Ms Rowley.

 

 

  1. Recommendation

The Minister is recommended to appoint Mr Richard Bell as:-

  •  the Interim Treasurer, the person appointed to carry out the functions of the office of Treasurer while the office is vacant; and
  •  Interim Accounting Officer for the Treasury and Resources Department and of the special and trust funds which Ms Rowley previously held Accounting Officer responsibility.

Article 29(5) (a) the Public Finances Law provides for an interim appointment in order to ensure that the functions of the office are properly fulfilled.  Articles 37 and 38 of the Law cover the appointment of Accounting Officer for the Department and associated special and trust funds.
