Legislation Advisory Panel: Appointment of Members.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Legislation Advisory Panel: Appointment of Members

Decision(s):  The Deputy Chief Minister, acting on behalf of the Chief Minister and on the recommendation of the Legislation Advisory Panel, approved the attached Report and Proposition recommending the appointment of the following States Members to the Legislation Advisory Panel:

  • Deputy Juliette Gallichan
  • Deputy Colin Egré.

Reason(s) for Decision: On 4th April 2006 the States approved the appointment of the following States Members to the Legislation Advisory Panel (P.32/2006):

  • Senator Jim Perchard
  • Senator Ben Shenton
  • Connetable Derek Gray
  • Deputy Andrew Lewis

The States also confirmed the continued appointment of Connetable Ken Vibert as the Chairman of the Panel.

However, now that  Senators Shenton and Perchard have been appointed as Minister and Assistant Minister for Health and Social Services respectively, there are two vacancies on the Legislation Advisory Panel following the standing down from the Panel of the said Senators.

Although the approval of the States is not obligatory, it is suggested that it would be desirable

to seek the support of the Assembly.  Deputy Juliette Gallichan and Deputy Colin Egre have agreed that they would be willing to serve on the Legislation Advisory Panel.

Connetable Derek Gray and Deputy Andrew Lewis have both agreed that they are willing to continue in their role as members of the Panel and Connetable Ken Vibert as Chairman of the same Panel.

Resource Implications:  There are no financial or manpower implications.

Action required:  For the Greffier to lodge au Greffe the Report and Proposition for States approval recommending the appointments to the Legislation Panel as soon as is practicable.
