Tidal Power Group

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: The establishment, membership and terms of reference of ‘The Tidal Power Group’

Decision(s):

 

1. The Minister for Planning and Environment has established a task group to produce a report outlining the future opportunities for Jersey in respect of tidal power and recommends to the Minister a future course of action. 

 

2. The membership comprises: Constable Dan Murphy (Chairman); Deputy Rob Duhamel; Deputy Sean Power; Sir Nigel Broomfield; Alick McIntosh (Icecap); David Padfield (JEC). Roy Bullen will also be called upon as an advisory member of the group.

 

3. Officer support will be from Chris Newton (Director for the Environment) and Louise Magris (Assistant Director for Environmental Policy)

 

4. There is no budget attaching to this work but the group can discuss the need to commission any further external work with the Environment Director.

 

5. The Terms of Reference for the Group are:

 

By the end of December 2008 produce a report for the Minister that sets out the following and makes recommendations, in respect of marine tidal energy :

·        The scope for contributing to Jersey's energy requirements from waters under the control of the States of Jersey;

·        The timescale for achieving this contribution;

·        What potential obstacles such as permission from the Crown, planning controls and marine user objections exist and how might they be overcome;

·        The economically feasibility of harnessing energy from local waters;

·        The funding mechanisms including possible strategic partnerships and access to external funding;

·        Activities that could be undertaken in the short term on a "no regrets" basis;

·        To explore the technology available to harness tidal power and the current readiness of this technology to deliver a tested solution.

 

6. In the production of the report, the Group will liaise with appropriate bodies including the Environment Department, the JEC etc.

 

7. The group is convened for this purpose alone but may be asked by the Minister to undertake further work following his consideration of their report.

To assist with the implementation of energy policy and the goal of achieving secure, affordable and sustainable energy for Jersey through a better understanding of the potential the future opportunities in respect of tidal power

3. The Director of the Environment to communicate the terms of reference to the group’s members.
