Jersey Aircraft Registry: Appointment of Interim Registrar

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:

The appointment of the interim Registrar of Aircraft, Jersey Aircraft Registry.

Decision(s):

The Minister agreed to appoint Mr. Bob Commander, through Commander Aviation Services, as the interim Registrar of Aircraft, Jersey Aircraft Registry, for a maximum period of 6 months.

Reason(s) for Decision:

On 8th July 2014, the States adopted the Aircraft Registration (Jersey) Law 2014 (the “Law”) and subsequently, on 20th September 2015, approved the draft Aircraft Registration (Jersey) Law 2014 (Appointed Day) Act 201- which brings the Law into force the day after the Act is debated.

 

Article 2 of the Law provides for the Minister for Economic Development (the “Minister”) to appoint a person to hold the office of the Registrar of Aircraft. The person appointed is required to have relevant experience and expertise in civil aviation and be a fit and proper person to hold the office of Registrar of Office. The Minister is empowered to appoint any person to perform on behalf of the Registrar of Aircraft such of the Registrar’s functions as the Minister or the Registrar may authorize. Provision is also made in Article 2 for the Minister to discharge the functions of the Registrar, where no Registrar is appointed by the Minister.

Resource Implications:

A financial agreement (up to £550 per diem or part thereof plus reasonable pre-approved expenses) has been reached between the Economic Development Department and Commander Aviation Services for the services of Mr. Bob Commander.

Action required:

The Strategic Policy Manager is to prepare and agree a contract within the parameters established above for signing by the Accounting Officer.
