Employment (Minimum Wage) (Amendment No. 7) (Jersey) Regulations 201- request further law drafting and withdrawal of P.172/2010

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Request further law drafting to amend the draft Employment (Minimum Wage) (Amendment No. 7) (Jersey) Regulations 201-.

Decision(s): The Minister decided that the Minimum Wage Regulations must be amended to reflect the policy intent that where an employee earns the trainee rate, the employer may not offset amounts in respect of accommodation and food. To achieve this, the Minister decided to withdraw the Proposition P.172/2010 so that it may be re-lodged including this further amendment.

Reason(s) for Decision: Since lodging P.172/2010, the Minister has become aware that the Minimum Wage Regulations do not meet the former Minister’s intention (based on the Employment Forum’s 2007 recommendation) that it should only be permissible for an employer to offset amounts for accommodation and food when an employee is being paid at least the full minimum wage, not the trainee rate.

 

This was addressed via an amendment to the Minimum Wage Regulations that came into force on 1 April 2007. In 2008, the Minimum Wage Regulations were again amended and the paragraph that prevented this offsetting against the trainee rate was excluded in error.

 

Rather then prepare a separate amendment, the Minister decided to withdraw the lodged Proposition so that an amendment may be inserted to accord with that decision. The revised legislation and accompanying report would then be re-lodged on 21 December 2010, for debate on 1 February, 2011.

Resource Implications: There are no financial implications.

Action required: Policy Principal to send drafting instructions to the Law Draftsman.
