La Gigoulande Quarry, La Rue de la Vallee, St. Peter: Planning Application (P/2012/0121): Determination of application by Minister

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

The installation and operation of an inert waste recycling facility for the production of secondary aggregate and soils and the restoration of the Western part of La Gigoulande quarry to agriculture and woodland using inert fill.

 

Decision(s):

Following his Public Ministerial Meeting on 5th April 2013 and subsequent site visit on 12th April, 2012, the Minister has decided to refuse the application. In arriving at his decision, the Minister paid due respect to the case made out by the Applicant’s agent, including the comprehensive Environmental Impact Assessment, and to all consultation responses and representations received.  He also paid regard to the comments made at a meeting organised by the Parish of St Peter, held on 16th April 2013 and attended by the applicant’s, members of the public and Officers of the States.

 

Reasons for Decision:

 

1. The proposed development would result in a significant increase in heavy goods traffic in both directions along La Rue de la Vallee. Such increase could seriously harm the amenities of nearby residents, pedestrians and cyclists by virtue of noise, vibration, dust and highway safety issues. Accordingly, the proposal is considered to be contrary to Policy GD1 of the 2011 Island Plan.

 

2. The proposed importation of inert waste to the quarry over a time-span of 25 years or more will discourage the recycling and re-use of such waste materials within the site on which they originated. This will not represent the most effective or efficient use of resources or energy and, accordingly, the proposal is considered to be contrary to the provisions of Policies SP2 and WM1 of the 2011 Island Plan.
