Budget transfer from Central Contingencies to Children, Young People, Education and Skills, and Health and Community Services: Pay Awards 2018/2019

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:

The allocation of £4,081,670 in 2019 from Central Contingencies to Children, Young People, Education and Skills (CYPES) and Health and Community Services (HCS) departments, to cover the recurring cost associated with the additional 2018 and 2019 Pay Award in respect of Teaching Assistants, and to cover the 2018 recurring costs and 2019 Pay Award for Nurses & Midwives, both in 2019.

Decision(s):

The Minister approved a non-recurring allocation of £4,081,670 from the Central Contingencies to the CYPES and HCS departments as per the attached report to fund the additional 2018 and 2019 Pay Awards for Teaching Assistants and Nurses & Midwives pay groups in 2019.

Reason(s) for Decision: 

Article 58 of the Public Finances (Jersey) Law 2019 states that the provisions of the previous Law, as they have effect immediately before the 2019 Law came into force, continue to apply to money received, expended or otherwise handled by or on behalf of the States during the financial year in which this Law came into force.

 

Article 17(2) of the Public Finances (Jersey) Law 2005 states that the Minister for Treasury and Resources is authorised to approve the transfer from contingency expenditure or the insurance fund of amounts not exceeding, in total, the amount available for contingency expenditure in a financial year. 

 

The current Contingency Allocation Policy (published as R.38/2019) states: “This process replaces all other processes and applies to all elements of Contingency allocated in the MTFP excluding Pay, Pensions and Voluntary Redundancy.”

Resource Implications:

Central Contingencies to decrease by £4,081,670 in 2019, the CYPES Department revenue head of expenditure to increase by £191,475 and the HCS Department revenue head of expenditure to increase by £3,890,195.

 

This decision does not change the total amount of expenditure approved by the States in the Medium Term Financial Plan 2016 to 2019.

Action required: The Head of Financial Governance to advise the Head of Finance Business Partnering of the receiving departments that this decision is approved.
