Review of protected building and site designation processes and criteria

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister for Planning and Environment;

  1. endorsed the proposals for the review of the ‘protected’ building and site designation, processes and criteria, including the introduction of: a single tier of designation for buildings and sites; a grading system; a revised and consolidated set of assessment criteria, as set out in the report, but subject to the introduction of additional levels in the proposed grading system in order to indicate the relative ‘quality’ of a protected building or site;
  2. delegated the Principal Historic Buildings Advisor to liaise with Jersey Heritage to develop additional grading levels;
  3. requested that the proposals be the subject of consultation with the constituent members and groups represented on the Ministerial Registration and Listing Advisory Group, prior to any request for legal advice

Reason(s) for Decision:

  1. The proposals arising from the review of the ‘protected’ building and site designation, processes and criteria will ensure that the Minister better meets his obligations under the PB(J)L2002 and the Island’s obligations under the terms of international conventions, so far as they relate to the historic built environment;
  2. The proposals respond to the objectives set by the Minister in his decision MD-PE-2007-0150.

Action required:

  1. PHBA to liaise with Jersey Heritage to develop additional levels;
  2. Subject to 1 above, AD/PHBA to consult constituent members and groups represented on MRLAG;
  3. Subject to favourable response to 2 above, AD to seek the advice of Crown officers of legal implications of proposed changes, and otherwise to refer the matter back to the Minister before seeking legal advice.
