Social Security Medical Board: Appointment of Medical Board Practitioners

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Social Security Medical Board – Appointment of Medical Board Practitioners

Decision(s): The Minister approved the appointment of two medical practitioners to undertake medical boards as provided for under the provisions of Article 34 of the Social Security (Jersey) Law 1974.

Reason(s) for Decision: An increase to the pool of appropriately qualified doctors is required to ensure that the Department can assess benefit entitlements in a timely manner.

REPORT

 

 

Article 34AA of the Social Security (Jersey) Law 1974  includes provision for the Minister to appoint to appoint medical boards, each consisting of one or 2 medical practitioners to determine questions relating to Incapacity Benefits .

 

The department therefore requires a pool of appropriately experienced doctors appointed to ensure that medical boards are undertaken and benefit claims assessed in a timely manner. 

 

The Minister for Social Security is satisfied that the following Doctors have suitable knowledge and experience to undertake the role of a medical board practitioner. 

 

 

 Dr Frederik Rud MBChB, MRCGP, DFSRH, LoC-SDI

 

Dr Rud has been practicing as a GP since 2012 and has worked at 3 medical practices in Jersey. Currently Dr Rud is working as a Forensic Medical Examiner for the States of Jersey Police.

 

Dr Rud attended the Jersey General Hospital for both Foundation and stage 1 GP training before moving to the UK to complete his training. Upon completion of his training the family moved back to Jersey.

 

Dr Neil Lloyd-Jones MBBS MRCGP LLB LLM BVC ADR

 

Dr Lloyd-Jones has been a GP since 1991 and also qualified as a Barrister in 2002. Dr Lloyd-Jones has been the senior partner in the Newcastle Medical Centre since 1992. In addition Dr Lloyd-Jones has worked extensively in the area of mental health assessments and also as a Benefits Agency Doctor in the past.

 

Dr Lloyd-Jones has significant experience as an expert witness for H.M. Police and the Crown Prosecution Service.
