2008 Year End Carry Forwards.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): 

The Minister decided to rescind decision MD-TR-2009-0040 due to a late amendment to carry forward proposals. 

The Minister approved the transfer of the £5,448,880 available underspend from 2008 to the following departments as per the accompanying report.

Reason(s) for Decision:

The Minister was notified of a late amendment to carry forward requests from departments. 

Under Article 15(1) of the Public Finances (Jersey) Law 2005 the Minister for Treasury and Resources can permit all or any part of the amount appropriated by a head of expenditure to

(a) be used for the purposes of another head of expenditure; or

(b) in the case of revenue expenditure, be withdrawn from the consolidated fund after the end of the relevant financial year.

Resource Implications: 

Other than those detailed in the report there are no further financial or manpower Implications.

Action required:

Treasury Officers to inform departments of the decision and action the associated transfers of funds.

2008 YEAR END CARRY FORWARDS  
 

Purpose of Report  

To enable the Minister to make approvals under Article 15(1) of the Public Finances (Jersey) Law 2005. 

Summary  

The total underspend for the States in 2008 amounted to £5,448,880. The year end position and the proposed carry forwards were considered by the Council of Ministers at its meetings of 5 March and 19 March 2009 and by the Corporate Management Board at its meeting of 12 March 2009. The Minister for Treasury and Resources has considered their views and has, in summary, agreed to:

  • Allow certain departments to carry forward, in part or in full, amounts requested;
  • Transfer some underspent funds to departments with significant 2009 funding pressures;
  • Transfer £1,288 from the States Assembly head of expenditure to the Dean of Jersey head of expenditure in 2008

 

Year End Position  

The table in Appendix A shows:

  • The year end variance (i.e. under or overspend) for each States Funded Body
  • The carry forward of underspends requested by each States Funded Body
  • The Minister’s decision on allocation of the available underspends to each States Funded Body

 

Significant funding pressures in 2009 were identified by the following departments:

  • Chief Minister’s
  • Economic Development
  • Treasury and Resources

 

These have therefore received reallocations in excess of their relevant departmental underspend for 2008.  Details of the purposes for which funding has been allocated are attached at Appendix B. 

Recommendation  

That the Minister:

  • approves the transfer of £1,288 from the States Assembly head of expenditure to the Dean of Jersey head of expenditure in 2008
  • approves the carry forward of expenditure approvals totalling £5,488,880 as detailed in Appendix A.
  • authorises the Head of Decision Support to inform departments of the Minister’s decision and action the associated transfers of funds.
