HM Prison: Prisoners: Temporary Release at Christmas: Extension

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister gave her approval for periods of temporary release to be extended at Christmas. This would only apply to temporary release spent in Jersey.

 

 

Reason(s) for Decision:

The slightly longer period of temporary release allows prisoners to be able to spend more time                 with their families or significant others at a time when they are less likely to be at work or school     (this is particularly important for those with children).

Seasonal variation to the Temporary Release Scheme for Christmas 2015

 

This report seeks the Minister’s approval to vary the terms of the Temporary Release Scheme to take account of the forthcoming seasonal holidays.

 

  1. This request seeks the Minister’s approval to:

 

1.1.   Extend the period of Home Leave permitted from 2 days to 6 days.

 

1.2.   Approve up to 1 day (8hrs) temporary release for any prisoner who currently has short duration community visits of (5hrs), this to be taken at an approved address.

 

  1. The Issue

 

2.1.   The Minister has previously approved the extensions of time on community release at Christmas each year since 2010. The slightly longer period of temporary release allows prisoners to be able to spend time with their families or significant others at a time when they are less likely to be at work or school (this is particularly important for those with children).

 

2.2.   To permit those who have demonstrated a responsible attitude and have been risk assessed by the panel for short duration visits of 5hrs the opportunity to spend a full day with their families or significant others.

 

2.3.   There will be no change to the eligibility criteria for temporary release for Christmas and prisoners will not be permitted to leave the Island at this time.

 

  1. Recommendation

 

3.1.   The above proposals are supported by Temporary Release Panel and it is recommended that the Minister approves this extension to temporary release.
