Economic Development Delegation of Powers to Officers of Jersey Post

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister approves the delegations detailed on the attached report, dated 27 January 2006.

Reason(s) for decision:

The Minister is requested to reconfirm existing delegations made under the Post Office (Jersey) Law 1969 to the Officers of Jersey Post. This is required to continue the day to day business of Jersey Post. The Officers also require the ability to put forward a draft Strategic Plan for submission to the Treasury and Resources Department under the terms of its draft Memorandum of Understanding as well as the ability to seek the approval of the Minister for Treasury and Resources in relation to leases according to the principles of Standing Order 168, Land Transactions.

Action required:

(i) Jason Lane to circulate to relevant officers for information and to Chief Executive officer of Jersey Post.

(ii) Jason Lane to forward to the Assistant Greffier and the Publications Editor by email the report for reformatting and presentation to the States.

Maintain the current provision of post offices within Jersey.

The Chief Executive Officer, Finance Director and Human Resources Director of Jersey Post to carry out under existing policies determined by the former Committee for Postal Administration and to bring any proposed significant changes to those policies to the Minister for approval.

Collect, receive, forward, convey and deliver in such manner as it thinks expedient all postal packets transmitted within, to and from Jersey.

The Chief Executive Officer, Finance Director and Human Resources Director of Jersey Post to carry out under existing policies determined by the former Committee for Postal Administration and to bring any proposed significant changes to those policies to the Minister for approval.

Perform services for the States or for any Ministry of the States of Jersey for the government of the United Kingdom or for the government of any country or territory outside Jersey or for any foreign postal administration on such terms and conditions as the Ministry may think fit.

Perform such services on behalf of the bodies set out in the Schedule to the Post Office Law 1969, as it thinks fit. Currently this would include:

(i) Alliance & Leicester Plc;

(ii) The British Broadcasting Corporation; and

In addt In addition to these bodies perform such services on behalf of the following bodies:

(iii) Barclays Bank;

(iv) Lloyds Bank;

(v) National Savings Bank;

(vi) Utility companies;

(vii) Other States Departments;

(viii) Any other body regulated in Jersey by a lawfully created regulatory body.

Enter into contracts with any person for or in respect of the carriage of postal packets by such means and on such terms and conditions as the Ministry may think fit.

The Chief Executive Officer, Finance Director and Human Resources Director of Jersey Post to carry out under existing policies determined by the former Committee for Postal Administration and to bring any proposed significant changes to those policies to the Minister for approval. This would include entering contracts for the day to day running of the business (e.g. Postage Accounts, Business Reply) on similar terms and conditions as were offered by the former Committee for Postal Administration.

Generally do all others things which, in its opinion, are necessary or desirable to facilitate the proper administration of the services provided by Jersey Post.

Draft MoU between the Treasury & Resources Department and “Jersey Post International Ltd”

To enable continuity and efficiency in the preparation and implementation of business plans, the Minister for Economic Development is requested to delegate to the Chief Executive Officer, Finance Director and Human Resources Director of Jersey Post, the progression of the 2006-2008 Strategic Plan, for submission to the Treasury & Resources Department, under its draft MoU.
