Pharmacy Registration: Various Premises

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Registration of Pharmacy Premises

 

 

  1. Background

 

Three separate applications have been received in accordance with Article 74 of the Medicines (Jersey) Law 1995 for the registration of premises as a pharmacy.

 

1.1.     An application from Mr Matthew Johnson, Director of MJJ Trading Ltd, in relation to a premises located at 24 Beresford Street, St Helier, JE2 4WN. The pharmacy business will trade under the name of LV Pharmacy.

 

1.2.     An application from Mr Mark Cox, Chief Operating Officer of Edgar Holdings, in relation to the relocation of an existing pharmacy within Grande Marche, La Rue le Masurier, St Helier, JE2 4YE

 

1.3.     An application from Dr Phil Terry, Managing Director of LG Pharmacy Ltd, in relation to a premises at Little Grove Clinic, Rue du Haut, St Lawrence, JE3 1JZ. The pharmacy business will trade as Little Grove Pharmacy.

 

The plans for all three premises have been inspected by the Chief Pharmacist and all are considered suitable for the purpose of carrying on a retail pharmacy business. Proposed security arrangements at all three premises meet the necessary requirements of the Medicines (Jersey) Law 1995 and the Misuse of Drugs (Jersey) Law 1978.

 

In the case of a pharmacy business which is operated by a corporate body, (as opposed to one carried on by an individual pharmacist), that company must ensure that all dealings in medicinal products are undertaken under the direction and management of a Superintendent Pharmacist, who has legal and professional responsibilities for the conduct of the business

 

Arrangements made for the sale and supply of medicinal products are considered satisfactory and in all three cases will be under the direction and management of a Superintendent Pharmacist as required by Article 70 of the Law.

 

 

  1. Recommendation

 

The Minister is requested to approve the registration of the following premises as pharmacies in accordance with the provisions of Article 74 of the Medicines (Jersey) Law 1995 with immediate effect.
