Road Traffic (St. Lawrence) (Jersey) Order 1990: Amendment: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

DEPARTMENT FOR INFRASTRUCTURE

 

ROAD TRAFFIC (ST LAWRENCE) (JERSEY) ORDER 1990

 

 

Purpose of the Report

 

To seek the Minister’s approval to amend the Road Traffic (St Lawrence) (Jersey) Order 1990.

 

 

Background

 

The Parish has requested four minor amendments to this Traffic Order.

 

Discussion

 

  1. Motorists leave commercial vehicles for long periods on the west side of La Route de St Jean, just south of its junction with La Rue des Bilieres. Doing so means that fewer parking spaces are available to nearby residents. Following a site meeting between a parish representative and an officer from DfI it was agreed that the Minister should be requested to introduce a waiting restriction of 12 hours maximum stay, which would be applicable every day including Sunday (Plan 1).

 

  1. The Minister is also requested to make permanent a temporary roadside waiting prohibition on La Grande Route de St Laurent just to the north of the British Union Hotel (Plan 2).

 

  1. Motorists park for long periods on the road adjacent to the village shop and the pub on La Grande Route de St Laurent, which leaves insufficient parking for shop customers. The Minister is therefore requested to restrict the parking period to 20 minutes between 8am and 5pm, every day including Sunday (Plan 2).

 

  1. The Minister is requested to prohibit waiting on part of Rue de la Blanche Pierre due to inconsiderate parking on the approach to the sharp bend near the southern end of the road. Such parking restricts access for emergency services to properties north of the bend (Plan 3).

 

 

Recommendation

 

The Minister is recommended to approve the requests.
