Prison - Request for Extension of Temporary Release at Easter.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

The Minister approved the extension to temporary release at Easter.

Reason(s) for Decision:

The slightly longer period of temporary release allows prisoners to be able to spend more time                 with their families or significant others at a time when they are less likely to be at work or school     (this is particularly important for those with children. 

Resource Implications:

There are no resource implications to the Home Affairs Department resulting from this decision. 

Action required:

The Prison Governor to arrange for eligible prisoners to be considered in the normal way for this period of temporary release.

TEMPORARY RELEASE AT EASTER (2009) 

1. The purpose of the Report 

  1. The report seeks the Minister’s approval to:

 

i) Extend the period of temporary release permitted at Easter from 2 days to 4days. 

ii) Approve up to 1 day (8hrs) temporary release for any prisoner who currently has short duration community visits of (3hrs) this to be taken at an approved address. 

2. The Issue 

  1. The previous Minister approved the extension of time for temporary release at Easter in 2008 for the same duration as described above (1.1i and 1.1ii). The slightly longer period of temporary release allows prisoners to be able to spend time with their families or significant others at a time when they are less likely to be at work or school (this is particularly important for those with children).

 

2.2 The ability to permit those who have demonstrated a responsible attitude and have been risk assessed by the panel for short duration visits of 3hrs the opportunity to spend a full day with their families or significant others. 

2.3 I do not intend to make any changes to the eligibility criteria for temporary release for Easter, or allow prisoners to leave the Island at this time. 

3. Recommendation 

  1. The proposal is that eligible prisoners will be able to apply for up to 4 days 3 nights temporary release at Easter or up to 8hrs if they currently have community visits.

 

  1. The proposal is supported by the Temporary Release Panel.

 

  1. The Minister is asked to approve this extension to temporary release.
