Church of the Sacred Heart, La Neuve Route, St. Brelade - List as Site of Special Interest.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister for Planning and Environment determined that;

  • A Notice of Intention to List the Church Of The Sacred Heart, La Neuve Route, St. Brelade as a Site of Special Interest shall be served on the owner/s of the site.

Reason(s) for decision:

  1. The special interests of the Church Of The Sacred Heart, La Neuve Route, St. Brelade, as defined in the schedule and relative to the published criteria for selection, justifies its inclusion on the List of Sites of Special Interest in accordance with the provisions and purposes of the Planning and Building (Jersey) Law and;
  2. It accords with the States Strategic Plan commitment of protecting and sympathetically managing the Island’s built heritage assets.

Action required:

  • The Notice of Intention is to be served in accordance with the requirements of the Law;
  • No sooner than 28 days after the date of the service of the Notice of Intention to List a further report will be brought back to the Minister relative to any representations received.

This report has been prepared by the Jersey Heritage Trust as part of its responsibility under a Service Level Agreement to provide reports and recommendations to the Minister for Planning and Environment on the registration of historic buildings and sites.

Relevant interests of the site (see schedule for detail)

The Church Of The Sacred Heart was included on the first historic buildings register, published in August 1992. It was confirmed as a pSSI by the Jersey Building Heritage Sub-Committee on 24 September 2001.

The Church Of The Sacred Heart is considered to be of special architectural, historical and artistic interest.

The church was completed in 1947 and is well-crafted in thirteenth century Gothic style. The church has high townscape value with its bell-cote designed to make the building a landmark in the bay.

Advice received (MRLAG or others)

The Architectural History Practice Limited – funded by English Heritage and the RC diocese of Portsmouth – published a report on the Church Of The Sacred Heart in March 2007. The report supports the designation as an SSI and concludes that the church is, “a very well crafted and pleasing design, which by UK criteria might be regarded as a candidate for listing in grade II.”

The special interest of the building was considered by MRLAG at its meeting on 13 August 2007. Members unanimously concurred with the prepared SSI schedule and plan.

JHT recommendation

It is recommended that the Minister for Planning and Environment:

  • confirm the intention to List the Church Of The Sacred Heart, as defined in the attached schedule, as a Site of Special Interest under the provisions of Article 51(2)(b) Planning and Building (Jersey) Law 2002 by virtue of its special interest as described in the same schedule;
  • approve the serving of the Intention to List Notice in accord with the requirements of the Law

Justification relating to criteria

The special interest of the Church Of The Sacred Heart, as defined and assessed relative to the published criteria for selection, justifies its inclusion on the List of Sites of Special Interest in accordance with the provisions and purposes of the Planning and Building (Jersey) Law 2002.
