Le Squez, St. Clement: Phase 3: Construction of 21 New Homes: Approval

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

  • Approved the scheme as set out in Application number P/2013/1712 and drawings numbered 4959/40, 4959/50, 4959/51 and 4959/55.

 

  • Approved and signed the Planning Obligation Agreement.

 

  • Requested that the Minister for Treasury & Resources accept his recommendations in accordance with States Standing Order 168 (1) (d).

 

  • Requested that the Minister for Treasury and Resources notes that the Minister for Housing has signed the Planning Obligation Agreement on behalf of the owner.

 

Reason(s) for Decision:  

To comply with the requirements of the States Standing Order 168 (1) (d) and the condition of the Planning Obligation Agreement.

Resource Implications:

REPORT TO THE HOUSING MINISTER

TO APPROVE THE SCHEME TO BUILD 21 NEW HOMES ON PHASE 3 LE SQUEZ,

ST CLEMENT.

 

 

Background

 

The Minister will recall that on the 21st October 2013, he endorsed the feasibility study proposals for the development of Phase 3&4 Le Squez, St Clement. (MD-H-2013-0086 refers and attached at annex a) where he;

 

  • Endorsed the feasibility study proposals as set out in the Written Report.

 

  • Authorised the Design Team to submit drawings for Byelaw and Planning applications.

 

  • Approved the budget transfer from HYR000 to HYR058 – Le Squez Phase 3&4 as detailed in the written report.

 

The Design team, lead by Morris Architects, submitted a Planning Application to demolish existing dwellings and construct 16 No. four bedroom, 4 No. two bedroom and 1 No. three bedroom dwellings, which has now been granted, subject to the satisfactory completion of a Planning Obligation Agreement, to secure a financial contribution towards the Eastern Cycle Route provision amounting to a total contribution of £21,000. A Building Bylaws permit has also been submitted and approved, a copy of the permit, documents and drawings numbered 4959/40, 4959/50, 4959/51 and 4959/55 are attached at annex b.

 

The Minister will also recall that on 13th May 2014 he Approved this scheme as set out in Application number P/2013/1712 and drawings numbered 4959/40, 4959/50, 4959/51 and 4959/55.(MD-H-2014-0029 refers). However, at the time this report was written, the department was of the understanding that the Treasury & Resources Minister was required to approve and sign the Planning Obligation Agreement.

 

Following advice from Jersey Property Holdings it transpires that The Housing Minister should, in fact, be the signatory of the Planning Obligation Agreement. This report therefore supersedes MD-H-2014-0029 and is amended to include the Housing Minister’s approval and signing of the Planning Obligation Agreement.

 

Recommendation

 

That the Minister:

 

  • Rescind Ministerial Decision MD-H-2014-0029.

 

  • Approve the scheme as set out in Application number P/2013/1712 and drawings numbered 4959/40, 4959/50, 4959/51 and 4959/55.

 

  • Approve and sign the Planning Obligation Agreement.

 

  • Request that the Minister for Treasury & Resources accept his recommendations in accordance with States Standing Order 168 (1) (d).
