3 Harbour View, Rue du Pont, Grouville - removal from Historical Building Register

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Purpose of the Report

This report seeks to regularise the status of this building by removing its BLI registration.

Background

A recent planning proposal has brought to light an unfortunate situation whereby this property, whilst shown as a BLI, was in fact demolished and rebuilt in approximately 2000 / 2001 on the advice of / with the consent of the then Assistant Director – Design and Development. This was as part of a renovation / extension project which was permitted and commenced, but apparently suffered some collapse during the works. Correspondence ensued during which both the then Historic Buildings Officer and Assistant Director considered the matter and effectively agreed to the demolition.

The building has remained on the Register even though it is a new structure with no historic elements remaining. In order to deal with the current proposals, and to remove this anomaly from the Register, the matter is brought forward at this late stage.

Discussion

The protection of historic buildings is dealt with initially by the JHT making recommendation to the Minister. Where they are registered, this becomes a material consideration within the planning process. It may be that in 2000 / 2001, the status of such buildings was not dealt with so rigorously, and clearly having sanctioned demolition, officers failed to reflect their decision in relation to the register.

As further proposals have now come forward it is necessary to correct this situation as a ‘new’ building cannot meet the criteria for inclusion as a BLI, even if it appears as a reasonable replica.

Conclusions

It is regretted that this report is necessary but in order to regularise the matter, and to ensure that the buildings which are protected in Jersey warrant that protection, the Register needs to properly reflect the historic interest. It is to be hoped that situations such as this do not occur in future.

Recommendation

That 3 Harbour View, La Rue du Pont, Grouville be removed from the Register.
