Rate Appeal Board: Appointment of Members

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

THE STATES are asked to decide whether they are of opinion 

 

 in pursuance of Article 44 of the Rates (Jersey) Law 2005 to appoint 

 

Jeremy James Robin Johnson

Brian Ahier

 

 as members of the Rate Appeal Board, for the period ending 31st May 2014.

REPORT

 

The Rate Appeal Board is established under the Rates (Jersey) Law 2005. Members are required to hear and determine appeals against rateable values in accordance with the Law.

 

The Minister is delighted that the following members are willing to put their names forward for a further term of office and is grateful for the hours of service they have given freely over the years

Mr. B. Ahier

 

The Minister is grateful for the input of the Appointments Commission which is fully supportive of these reappointments and due to the infrequency of the Rate Appeal Board meeting and the need to maintain experience within the Board agreed an exception to its principle by allowing former members to exceed the normal 10 years limit to such appointments. However it is noted that the Commission stated that these appointments should be for maximum of 3 years and not extendable beyond this period.

 

Mr. Brian Ahier

 

Mr. Ahier is now retired having followed a career in the finance industry as a company secretary. He has been a President of the Jersey Football Association and Chairman of the Advisory Council for Education, Sport and Culture. Mr. Ahier has been a member of the Parish Rate Appeal Board since December 2000.

 

Mr. Jeremy Johnson

 

Mr. Johnson has been a member of the Parish Rate Appeal Board since 2000. He is also Chairman of the Caesarea Association. He has a legal background and has been a Partner in Galsworthy and Stones since 1977. Mr Johnson has been a Governor of Grainville school for 2 years.

 

 Financial and manpower implications

 

The posts are honorary and there are no financial or manpower implications for the States arising from this proposition.
