Request for funding from Contingency to meet costs of changes to Teachers’ Terms and conditions in 2011
- Introduction
As part of the negotiations between the States Employment Board and the Teachers Associations concerning the salaries and terms and conditions of teachers in Primary, Secondary and Special Education for the period 1st January 2010 to the 31st December 2011, changes were agreed to non-teaching time for planning, preparing lessons and assessing pupils (PPA) from the 1st January 2011 and to lunch time supervision from the 1st January 2012.
The Council of Ministers agreed when considering the CSR Part 2 proposals that the funding implications, amounting to £800,000 will be met from the Treasury Contingency, with specific reference to funding requirements in 2011. The Department had submitted growth proposals for this sum, which for 2012 has been included as part of the Business Planning process. There is a shortfall in funding for 2011 amounting to £500,000 for PPA.
2. Background
Specific changes to Teachers’ Terms and Conditions are detailed in the two year agreement:-
‘With effect from the 1st January 2011, all teachers in the employment of the States of Jersey will have a contractual right to 10% of their teaching time protected for planning, preparation and assessment ..’ and;
‘With effect from the 1st January 2012, teachers in the employment of the States of Jersey will no longer be required to undertake the lunch time supervision of pupils.’
The provision of 10% non-teaching time for primary school teachers is considered to be best practice in the United Kingdom. It has been implemented in the Island’s secondary schools however teachers in the primary sector only have access to 6%. The agreement has brought terms and conditions for primary teachers in to line with their secondary and UK counterparts. The additional non-teaching time ensures that a teacher is better able to determine the level of each individual child’s ability using national curriculum level descriptors; resources and teaching aids can then be tailored for each child based on their individual ability in order to stretch them to achieve their full potential.
3. Recommendation
That the Minister requests that £500,000 be allocated from the Treasury Contingency to the Department for Education, Sport and Culture in 2011 to meet the costs of the increased time for teachers PPA.
4. Reason for Decision

The annex to the Budget 2011 – ‘Comprehensive Spending Review – 2012 and 2013 Proposals’ (pg 30 and 31) states: “£800k ESC growth for Primary Teachers Terms and Conditions to be funded from central contingency”.
Article 15(1)(a) of the Public Finances (Jersey) Law 2005 states that all or any part of the amount appropriated by a head of expenditure may, with the approval of the Minister for Treasury and Resources, be used for the purposes of another head of expenditure.
5. Resource Implication
The T&R revenue head of expenditure to decrease by £500,000 and the Education, Sport & Culture Department revenue head of expenditure to increase by an identical amount.
This decision does not change the total amount of expenditure approved by the States for 2011.
