Road Traffic (St. Saviour) (Jersey) Order 2000

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

AMENDMENT TO ROAD TRAFFIC (ST. SAVIOUR) (JERSEY) ORDER 2000

 

 

Purpose of the Report

 

To amend the Road Traffic (St. Saviour) (Jersey) Order 2000.

 

 

Background

 

A request has been received from the Connétable of St. Saviour to add areas of prohibition of waiting and new areas of motorcycle parking in St. Saviour.

 

 

Discussion

 

The Connétable of St. Saviour has requested that the following new areas of prohibition of waiting be added to the Road Traffic (St. Saviour) (Jersey) Order 2000 as detailed below:

 

La Rue des Friquettes:

The Connétable has reported problems being experienced with parking in the area requested which are causing difficulties for residents accessing their properties. Adding a Prohibition of Waiting as described below will enable the Parish Honorary Police to effectively deal with this.

  • Add to the existing entry in Schedule 3 Part 1 “La Rue des Friquettes (both sides from the junction with Princes Tower Road to a point 57 yards north)” (Appendix 1)

Grands Vaux:

The Connétable has requested a change to one of the existing areas of prohibition of waiting to deal with existing problems.

  • Replace the existing entry in Schedule 3 Part 1 for Grands Vaux “north side (from its junction with Deloraine Road for a distance of 16 yards in an easterly direction)” with “north side (from its junction with Deloraine Road to a point 100 yards east)”
  • Add a new entry in Schedule 3 Part 1 for Grands Vaux “north side (from a point 143 yards east of the junction with Deloraine Road to a point 35 yards further east)”

Maison St. Louis:

The Connétable has requested three new areas of prohibition of waiting to deal with existing problems.

  • Add to the existing entry in Schedule 3 Part 1 “Maison St. Louis (south side from its junction with Wellington Road to a point 20 yards west)”
  • Add to the existing entry in Schedule 3 Part 1 “Maison St. Louis (south side from a point 39 yards west of its junction with Wellington Road to a point 15 yards further west)”
  • Add to the existing entry in Schedule 3 Part 1 “Maison St. Louis (north side from a point 111 yards west of its junction with Wellington Road to a point 15 yards further east)”

 

La Rue St Thomas:

The Connétable has requested a new area of prohibition of waiting to deal with existing problems.

  • Add to Schedule 3 Part 1 after the entry for La Rue Le Masurier “La Rue St Thomas (west side from its junction with Longueville Road to a point 75 yards further north)”

Le Jardin a Pommiers:

The Connétable has requested four new areas of prohibition of waiting to deal with existing problems.

  • Add to Schedule 3 Part 1 after the entry for Le Geyt Road “Le Jardin a Pommiers (west side from its junction with La Rue de Patier to a point 37 yards south)”
  • Add to Schedule 3 Part 1 “Le Jardin a Pommiers (east side from its junction with La Rue de Patier to a point 75 yards south)”
  • Add to Schedule 3 Part 1 “Le Jardin a Pommiers (west side from a point 37 yards south of its junction with La Rue de Patier to a point 30 yards further south)”
  • Add to Schedule 3 Part 1 “Le Jardin a Pommiers (east side from a point 75 yards south of its junction with La Rue de Patier to a point 12 yards further south)”

 

Parking of motorcycles:

The Connétable has requested a new Article be inserted to provide for areas set aside for motorcycle parking with a maximum stay period of 7 consecutive days.

  • Add a new Schedule for areas set aside for parking of motorcycles
  • Add to the new Schedule “Beach Road (east side from its junction with Beach Crescent to a point 6 yards south)”
  • Add to the new Schedule after the entry for Beach Road “Highlands Lane car parking area (the 2 marked bays to the south east of the designated parking area)”

 

Conclusion

 

The addition of the requested prohibition of waiting areas above will allow the Parish to police parking there and the creation of the new motorcycle parking areas will provide a much needed facility for motorcycle parking and supports one of the aims of the Sustainable Transport Plan.

 

 

Recommendations

 

The Minister is recommended to instruct Officers to issue Law Drafting instructions to amend the Road Traffic (St. Saviour) (Jersey) Order 2000.
