Road Traffic (Public Parking Places) (Jersey) Order 2006: Amendment required to add Ann Street Brewery Car Park

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister agreed to amend the Road Traffic (Public Parking Places) (Jersey) Order 2006.

 

Reason(s) for Decision: To add Ann Street Brewery Car Park with a maximum stay period of seven consecutive days and to allow overnight parking for commercial vehicles over 15 foot in length.  

 

Resource Implications: Law Draftsman time. Transport and Technical Services – signage and road marking £15,850.

 

Action Required: Officers to instruct the Law Draftsman to prepare an Amendment for subsequent submission to the Minister.

ROAD TRAFFIC (ST BRELADE) (JERSEY) ORDER 1990 - AMENDMENT

 

 

Purpose of the Report

 

To amend the Road Traffic (St Brelade) (Jersey) Order 1990

 

 

Background

 

On 16 March 2012 under Ministerial Decision MD-T-2012-0028 the Minister for Transport and Technical Services approved a request to amend the Parish Road Traffic Order to allow parking of vehicles in part of La Rue Voisin from its junction with Le Chemin du Portelet to its junction with the privately owned road that extends down to the new Portelet Bay Development.  At present waiting is prohibited on both sides of the road.

 

 

Discussion

 

The section where waiting will be permitted is indicated on the attached plan Appendix A.

 

“Prohibition of Waiting” lines will also be placed at road junctions on La Rue Voisin in accordance with Article 4(2) of the Order whereby waiting is prohibited within 10 yards of a junction without the need for an Order amendment.

 

In addition to changes in waiting restrictions in La Rue Voisin, in May 2012 the Connétable of St Brelade requested that “Prohibition of Waiting” lines be placed on both sides of La Route de Noirmont for 80 Yards (73 metes), in a southerly direction  from its junction with Travers Farm Lane.

 

This request is also shown on an attached plan Appendix B.

 

 

Recommendation

 

The Minister is recommended to approve the attached amendment to the Road Traffic (St Brelade) (Jersey) Order 1990, to come into force 14 days after it is made.

 

 

Reason (s) for Decision

 

  1. To remove a section of “Prohibition of Waiting” in La Rue Voisin
  2. To prohibit waiting on both sides of a section of La Route de Noirmont

 

 

 

 

 

Action Required

 

To notify the Publications Editor and the Law Draftsman that the Order has been made, forward the signed and sealed Order to the Publications Editor, States Greffe, and request the Greffier of the States to arrange for its notification to the States.
