Urban Renewal Transfer between Capital Heads of Expenditure

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

PLANNING AND ENVIRONMENT

URBAN RENEWAL TRANSFER BETWEEN CAPITAL HEADS OF EXPENDITURE

Purpose of the Report

The purpose of this report is to seek the Minister for Planning and Environment’s approval to transfer funds between existing capital heads of expenditure and request the approval of the Minister for Treasury and Resources to this transfer.

Background

To date the Urban Renewal Programme has been voted a total of £3.775 million which has covered a range of Urban Renewal Projects. During 2006 £0.200 million was voted to a capital head of expenditure for Urban Renewal; however the budget was transferred to a new capital vote C0971 – Urban Renewal 2006. The previous budget of £3.575 million was transferred to capital vote C0949 – Urban Renewal Programme.

Approval to transfer allocated capital budgets ('Heads of Expenditure') lies with the Minister for Treasury and Resources not the States as a whole (see extract from Financial Direction 3.6 below):

Transfers between capital heads of expenditure

· Approval of non-contentious transfers of up to £100,000 is delegated to the Treasurer of the States, or in his absence another person nominated by the Treasurer of the States.

· All other transfers between existing capital heads of expenditure require the approval of the Minister for Treasury and Resources.

· Transfers to new capital heads of expenditure require the approval of the Council of Ministers and the Minister for Treasury and Resources.

Discussion

To assist with the management and reporting of the Urban Renewal Programme we would like to request that the unspent budget of £0.126 million be transferred from capital vote C0949 – Urban Renewal Programme to capital vote C0971, which be renamed Urban Renewal Programme.

Recommendation

It is recommend that the Minister for Planning and Environment approve the transfer of funds between existing capital heads of expenditure, as highlighted below, and request the approval of the Minister for Treasury and Resources to the transfer.
