Hospital Charges (Long Stay Patients) (Jersey) Order 2007: Increase of Charges: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

The Minister approved an increase of 2.2% to long stay patient charges to take effect from 1st January 2014.

Resource Implications:

Long stay fee income will increase by £101,000 and outlined in the attached report. The increase is in accordance with Financial Directions.

 

Action required:

Law draftsmen to prepare an order to effect the 2.2% increase in long stay patient fees.

Hospital Charges for Long Stay Patients

 

1.                  Purpose of Report

To enable the Minister to approve an increase in Hospital Long Stay Charges and instruct the Law Officers to prepare an order to amend the Hospital Charges (Long-Stay Patients) (Jersey) Order 2007

2.                  Background

The Hospital Charges (Long-Stay Patients) (Jersey) Order 2007 permits the Department to make a charge for accommodation services to long stay patients over the age of 65. The 2013 charge amounts to £67.83 per day and this is increased each year by Ministerial Decision followed by a regulation and order to amend Article 2 of the Hospital Charges (Long-Stay Patients) (Jersey) Order 2007. The proposed increase in charges of 2.2% will increase the charge per day to £69.33.

 

Financial Direction 4.1 – Increases In States Fees and Charges – sets the parameters within which Departments review their fees and charges and aims to meet the requirements of the States Anti - Inflation Strategy which limits increases to 2.5%.

  1. Recommendation

 

The Minister is recommended to approve the increase in accommodation charges and personal allowances and request the Law Draftsmen to prepare an order to amend the Hospital Charges (Long-Stay Patients) (Jersey) Order 2007.

An Order to make changes to legislation requires a departmental Ministerial decision.

 

  1. Resource Implications

 

Departmental income budgets for long stay patients will increase by £101,000 per annum. This decision does not result in any overall increase or decrease in the net expenditure of the States, as approved in the MTFP 2013-2015.
