Budget transfer to Property Holdings for urgent maintenance/upgrade works at General Hospital

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Approval of the transfer of £770,000 approved carry forward from the Health and Social Services Department (HSSD) to Treasury and Resources (Jersey Property Holdings) in order to carry out urgent maintenance and upgrade works at the General Hospital in advance of the capital refurbishment of the Intensive Care Unit (ICU) scheduled for 2012

 

Decision(s):

The Minister approved the transfer of £770,000 from HSSD revenue cash limit to Jersey Property Holdings revenue cash limit in order to deliver enabling works in advance of the main ICU improvement and refurbishment project that is included in the 2012 indicative capital programme.

 

Reason(s) for Decision:

On 6th May 2011, the Treasury and Resources Minister made a formal decision MD-TR-2011-0042 in which he approved, inter alia, the use of the carry forward budget for enabling works in advance of the main ICU improvement and refurbishment, as part of a wider programme of urgent maintenance and upgrade works. The carry forward of £770,000 was created underspends in HSSD’s 2010 budget but the works will be carried out by Jersey Property Holdings as owner of the buildings. A budget transfer from HSSD to T&R, JPH is therefore required.

Article 15(1)(a) of the Public Finances (Jersey) Law 2005 states that all or any part of the amount appropriated by a head of expenditure may, with the approval of the Minister for Treasury and Resources, be used for the purposes of another head of expenditure.

Delegation 1.3 delegates authority for non-contentious transfers between expenditure heads of up to £1,000,000 to the Treasurer of the States.

 

 

 

Resource Implications:

Reduction of HSSD revenue cash limit of £770,000 and an increase in Treasury and Resources (Jersey Property Holdings) revenue cash limit by an identical amount to undertake enabling works in advance of programme capital works to the ICU, as part of an ongoing backlog maintenance programme.

 

This decision does not change the total amount of expenditure approved by the States for 2011

  1. Purpose of Report

The Treasurer is asked to approve a budget transfer of £770,000 from the Health and Social Services Department to the Treasury and Resources Department, Jersey Property Holdings (JPH) to fund prioritized items within the backlog maintenance programme targeted to improve clinical safety and refurbish the ICU.

 

 

  1. Background

2.1.            Following a review by the recently appointed hospital Managing Director a number of urgent maintenance and upgrade works were identified at the General Hospital and elsewhere across the HSSD estate.

2.2.            Various sources were identified to fund works in 2011, including the utilisation of unspent revenue budget of £770,000 achieved by HSSD in 2010.

2.3.            On 6th May 2011, the Treasury and Resources Minister made a formal decision MD-TR-2011-0042 in which he approved, inter alia, the use of the carry forward budget for this purpose.

 

  1. Funded Works

3.1.            It is intended that the funds be transferred to JPH to deliver enabling works in advance of the main ICU improvement and refurbishment project that is included in the 2012 indicative capital programme.

3.2.           The works to be funded form part of a wider programme that has been prioritised by HSSD that will be managed by JPH and delivered in conjunction with project management resources based at the Hospital.

 

  1. Recommendation

That the Treasurer approves a budget transfer of £770,000 from HSSD to Jersey Property Holdings’ revenue budget to provide funding for improved clinical safety and refurbishment of the ICU, in accordance with the carry forward request approved by the Treasury and Resources Minister in his decision MD-TR-2011-0042 of 6th May 2011.
