Price Indicators (Amendment) (Jersey) Regulations 201-

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Price Indicators (Amendment) (Jersey) Regulations 201-

Report to Economic Development Minister

Ministerial Decision to Lodge the Price Indicators (Amendment) (Jersey) Regulations 201-

Background

In November 2011 the States adopted P.146/2011 lodged by Senator Alan Breckon following the publication of a report by the Jersey Competition Regulatory Authority entitled Review of the Jersey market for road fuels. The proposition required the Economic Development Minister to bring forward for approval the necessary legislation to introduce a requirement for all retailers of road fuel to display prices at the roadside in such a way that they are clearly visible from the adjacent roadway. To implement the States decision it would be necessary to amend the Price Indicators (Jersey) Regulations 2008.

The Minister also considered a report by the Director of Trading Standards on the need to effect amendments to Article 5 of the Regulations to clarify the circumstances in which retailers may discount UK VAT equivalent prices charged in Jersey.

Subsequently the Minister signed a Ministerial Decision, MD-E-2012-0052, which authorised the Director of Trading Standards to provide drafting instructions to the Law Draftsman to facilitate preparation of an amendment to the Price Indicators (Jersey) Regulations 2008 that would:

  1. Give effect to the States decision of 2nd November 2011 to bring forward for approval the necessary legislation to introduce a requirement for all retailers of road fuel to display the price of road fuel on sale so that it is clearly visible to passing motorists from the adjacent roadway.
  2. To make appropriate amendments to the Regulations to clarify the circumstances under which traders may offer discounts on selling prices.

The amendments have now been drafted and the necessary internal checks completed.

Financial and Resource Implications

There are no resource implications for the States as a result of the draft amendment.

Recommendation

It is recommended that the Minister approves the attached draft Price Indicators (Amendments) (Jersey) Regulations 201- and authorises them to be lodged for debate as soon as possible.
