Appointment of Rosemary Pestana to Employment Forum.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Appointment of Rosemary Pestana to Employment Forum.

Employment Forum Membership

BACKGROUND

The Employment Forum is intended to consist of nine members, appointed on the basis of their interest in employment relations and diversity of backgrounds, with three employer, three employee and three independent representatives. The Employment Law requires that members are appointed by the Minister.

In August 2006, Mr William Doyle resigned from the Forum and, given the circumstances, his request to resign without notice was accepted by the Minister.

RECRUITMENT PROCESS

An advertisement was placed in the Jersey Evening Post, on the Social Security ‘Jobs in Jersey’ website and was sent to all of those on the Forum’s consultation database. Eight applications were received from good quality candidates and, following short-listing, four candidates were selected for interview.

It is standard practice for interviews to be conducted by one independent member and one member of the same category as the applicant. Acting Chair Sally Johnson (independent) and David Robinson (employee) conducted the interviews. Three candidates were interviewed as one did not arrive for his interview.

The interview panel considered that Mrs Pestana has a great deal of knowledge and experience that she can bring to the Forum. She has worked for Health and Social Services for 37 years, is a Transport and General Workers’ Union joint council member, district Delegate, and Regional and National Women’s Committee Delegate.

Mrs Pestana has been invited to join the Forum, subject to Ministerial approval, for a three year term of appointment, to begin on 1st November 2006.

The current members and their terms of appointment are:
