MRI Scanner - essential variation to replace the RF Cabin

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Replacement MRI Scanner – Approval of Variation

1. Background

1.1 The Health and Social Services Ministerial Decision Summary ref: MD-H SS-2007-0039, copy attached, confirmed approval of the lowest tender from Philips Ltd, to supply and install a 1.5 Tesla MRI Scanner.

1.2 Work on replacing the existing 1 Tesla MRI scanner commenced on 26 August and is scheduled to take 15 weeks to complete.

1.3 Following de-commissioning of the existing scanner, tests have taken place to test the RF Cabin (Radio Frequency Cabin) that reduces or eliminates the interference from radio frequencies outside the MRI Scanner room on the radio frequency being used by the scanner itself. The existing RF Cabin has failed this test and now needs to be replaced as a variation to the contract.

2. Present

2.1 The cost of stripping out and replacing the existing RF Cabin, including works to associate finishes and services is £53,807.

2.2 In compliance with the control of capital expenditure ‘Financial Direction No. 5.6’ item 5.8.16, any variation greater than £30,000 must be reported to the sponsoring Minister for approval.

2.3 This variation is essential and the new scanner will not work without it.

2.4 Contingency money is available within the existing budget and no additional funding is required.

3. Recommendation

The Minister for Health and Social Services is recommended to approve the variation to replace the RF Cabin for the new MRI Scanner at a cost of £53,807.
