Cuprokylt (Copper Oxychloride): Pesticide Temporary Authorisation

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister for the Environment approved the sale, dispersal, storage and use of Cuprokylt (copper oxychloride) as a fungicide on potato crops for a temporary period with immediate effect and terminating on 12 September 2017, as set out and recommended in the Cuprokylt (copper oxychloride) Temporary Authorisation Report, dated 16/03.2017.

Reason(s) for Decision:

In accordance with the Pesticides (Jersey) law 1991, the Minister may at any time give his approval in relation to a pesticide or amend the conditions of an approval; each approval may authorise the supply, storage and use of the pesticide to which it relates. In addition the Minister may approve a pesticide which has been authorised for use elsewhere subject to the conditions of use.

This decision supports Jersey Royal potato growers in Jersey.

  1. As soon as reasonably practical, give public notice in the Jersey Gazette of this Ministerial Decision.
  2. Issue any person or organisation wishing to use Cuprokylt in Jersey a “Temporary Authorisation for Cuprokylt” document.

Cuprokylt (copper oxychloride) Temporary Authorisation Report

Purpose of the Report

 

The Minister for the Environment (The Minister) is requested to:

 

  1. Approve the sale, dispersal, storage and use of Cuprokylt (copper oxychloride) as a fungicide on potato crops for a temporary period terminating on 12 September 2017.

 

Background

 

The Pesticides (General Provisions) (Jersey) Order 1991, article 4, enables the Minister at any time to give his approval, or amend the conditions of an approval, in relation to a pesticide of any description.

 

In the UK, Cuprokylt (marketed by Certis U.K.) has full approval for use on grape crops. It had full approval for use on potato crops until the end of 2016 but this use was withdrawn for commercial reasons. Cuprokylt was used in Jersey for many years, predominantly for the control of late blight in organically grown Jersey Royal potato crops. Its use was endorsed by the Soil Association. Since the authorisation for use on potato crops was withdrawn, organic growers have had no fungicides available with which to control late blight.

 

The U.K. emergency approval of Cuprokylt by the Chemicals Regulation Division (CRD) on potatoes for the period of 120 days commencing 15 may 2017 has been gained with the approval of the Soil Association. This has been welcomed by the organic sector in Jersey as it the only fungicide available for the control of late blight on organically grown Jersey Royal (and other) potato crops. A Jersey potato marketing group has asked the UK approval be extended to Jersey with immediate effect to reflect the Jersey earlier growing season.

Any person or organisation wishing to use Cuprokylt in Jersey must obtain a “Temporary Authorisation for Cuprokylt” document (as attached to this report) from the Department of the Environment. The document describes the product, provides advisory information, and sets out the conditions for authorised use, including crop maximum residue levels and spray operator protection requirements.

EXPLANATORY NOTES

  1. This is a temporary authorisation for Jersey following an emergency authorisation for the United Kingdom issued by the U.K. Chemicals Regulation Directive. 
  2. Neither the efficacy nor the phytotoxicity of the product for which this authorisation has been granted has been assessed and, as such, the user bears the risk in respect of failures concerning its efficacy and phytotoxicity.

ADVISORY INFORMATION

 

This temporary authorisation relates to the use of ‘Cuprokylt’ as a fungicide for the control of late blight caused by Phytophthora infestans on potatoes. Applications to be made via a conventional hydraulic sprayer, air assisted hydraulic sprayer or knapsack sprayer in a water volume of 1100 – 1300 litres of water / ha.

 

CONDITIONS OF AUTHORISATION FOR USE

 

The conditions below are obligatory.  They must be complied with when the authorisation occurs.  Failure to comply with the following conditions may result in other enforcement action, including prosecution.  For the purposes of this authorisation only, the conditions and/or requirements shown below supersede any corresponding conditions and/or requirements set out on the label or otherwise provided for under the product authorisation which would otherwise apply.

Operator Protection:

 

(1)     Spray equipment must only be used where the operator’s normal position is within a closed cab on a tractor or self-propelled sprayer when making broadcast air-assisted applications.

 

(2)     Other engineering control of operator exposure must also be used where reasonably practicable in addition to the following personal protective equipment:

 

(a)          Operators must wear suitable protective gloves and suitable respiratory protective equipment when handling the product.

(b)          Operators must wear suitable protective gloves when handling contaminated surfaces or applying by hand-held equipment.

(c)           Workers must wear suitable protective gloves when handling treated crops or contaminated surfaces.

(3)     However, engineering controls may replace personal protective equipment if a COSHH assessment shows that they provide an equal or higher standard of protection.

Other specific restrictions:
