Public Health and Safety (Rented Dwellings) (Licensing) (Jersey) Regulations 201-: Amendment to P.106/2019: Law Drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

  1. Purpose of Report

 

To brief the Minister on an amendment to P.106/2019, the Draft Public Health and Safety (Rented Dwellings) (Licensing) (Jersey) Regulations 201-.

 

  1. Background

 

Following a briefing to the Environment, Housing and Infrastructure Scrutiny Panel on 17 September 2019, the Minister instructed officers to lodge the Draft Public Health and Safety (Rented Dwellings) (Licensing) (Jersey) Regulations 201- (P.106/2019).

 

On 10th October 2019, the Minister received a written request from the Chairman of the Panel advising of their intention to commence a full scrutiny review on the proposition and further requested a deferral of the debate until the second sitting in January 2020.

 

The Minister agreed to the delay and as a consequence now requires the drafting of an amendment to P.106/2019 to effect the following changes:

 

  • Change the licence commencement date from 1st January to the 1st April, following the date on which it is granted, unless the Minister specifies another date of commencement in the licence, and expires on the anniversary of the date of commencement
  • Change the date the Minister must issue a new licence in respect of any dwelling that, on the day that these Regulations come into force, is a rented dwelling, if the application for the licence in respect of that dwelling is received from 31st March 2020 to 30th June 2020
  • If approved, the Regulations should come into force on 1st March 2020 and not 1st December 2019.
  • Amend the year in the title of the Draft Public Health and Safety (Rented Dwellings) (Licensing) (Jersey) Regulations 201- to 202-.

The Minister, taking into account the change of date for debate, to request the drafting of an amendment to the Regulations to reflect these changes.
