List of Sites of Special Interest: 7 Francis Street, St. Helier.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister for Planning and Environment determined 7 Francis Street, St Helier should be Listed as a Site of Special Interest on the basis of its architectural and historical interest, in accordance with criteria for designation.

Reason(s) for Decision:

  1. The retention of 7 Francis Street, St Helier as a Site of Special Interest is in accordance with the criteria for assessment and designation on account of its architectural and historical interest.
  2. It accords with the States Strategic Plan commitment of protecting and sympathetically managing the Island’s built heritage assets

Legal and Resource Implications:

Article 52(2)(b) of the Planning and Building (Jersey) Law 2002 enables the Minister to include on the List of Sites of Special Interest, those buildings and places that the Minister is satisfied has public importance by reason of the special archaeological, architectural, artistic, historical, scientific or traditional interest that attaches to the building or place.

Purpose of the Report

The purpose of this report is for the Minister for Planning and Environment to consider the retention of 7 Francis Street, St Helier on the List of Sites of Special Interest. 

Background and discussion

Following consideration of a report on the architectural and historical value of 7 Francis Street, St Helier by Jersey Heritage (dated 01 October 2008: attached at appendix 1) the Minister for Planning and Environment confirmed his intent to add this property to the List of Sites of Special Interest (MD-PE-2008-0234: attached at appendix 2). Notice of the Minister’s intention was duly served on the owners of the site on 22 October 2008, providing them with 28 days in which to submit representations. None have been received. 

Despite being served with a Notice of the Minister’s Intent to List this property, it was brought to the attention of the Planning and Environment Department on 25 November, that work was being undertaken to strip out the internal fabric of the building (photographs at appendix 3). As a result of damage to some and the clear threat to the remaining internal fabric of the building, the building was provisionally added to the List of Sites of Special Interest on 26 November. The Notice was served by the Department’s Enforcement Team and the owner was advised that any further internal work would be unauthorised. This action has prevented any further damage to the building. 

As a result of the stripping out work that has been undertaken, the building has lost its original ceilings, plaster finishes and integral cupboards. Notwithstanding this damage, the staircases, door cases, window places and fireplaces, together with structural timbers, still remain. On this basis, Jersey Heritage maintains its original recommendation that the building still merits retention on the List of Sites of Special Interest, relative to the Minister’s criteria for designation. 

Recommendation

On the basis of the above, Jersey Heritage would maintain the recommendation that this building should be Listed as a Site of Special Interest on the basis of its architectural and historical interest, in accordance with criteria for designation.
