Amendment to Road Traffic (Public Parking Places) (Jersey) Order 2006

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister agreed to amend the Road Traffic (Public Parking Places) (Jersey) Order 2006 and undertook to request Officers to instruct the Law Draftsman to prepare the Amendment.

Reason(s) for Decision: At the request of the Minister for Education Sport and Culture to make Springfield Stadium North Car Park a maximum stay of 3 hours in any continuous 24 hour period.

Resource Implications: Transport and Technical Services Officers and Law Draftsman time.

TRANSPORT AND TECHNICAL SERVICES  

AMENDMENT TO ROAD TRAFFIC (PUBLIC PARKING PLACES)  

(JERSEY) ORDER 2006  
 

Purpose of the Report  

At the request of the Minister for Education Sport and Culture to include Springfield Stadium North Car Park with a maximum stay of 3 hours in any continuous 24 hour period.   
 

Background  

The Minister for Education Sport and Culture has requested that the Springfield Stadium North Car Park be added to the Road Traffic (Public Parking Places) (Jersey) Order 2006 with a maximum stay of 3 hours in any continuous 24 hour period. 

The request to include this car park with a maximum stay period will help to deter long term parking and will enable users of the facilities there to park. The area has been found to be abused with long term parking when checked by Officers of the Education Sport and Culture Department. 
 

Discussion  

Officers support the inclusion of this car park with the maximum stay period detailed. The policing and enforcement of this would be carried out by Officers of Education Sport and Culture Department, and the Parish. 
 

Recommendations  

The Minister is recommended to approve the request from the Minister for Education Sport and Culture and to request Officers to instruct the Law Draftsman to prepare an Amendment to the Road Traffic (Public Parking Places) (Jersey) Order 2006 to incorporate this. 
 

Reason(s) for Decision  

To enable the addition of Springfield Stadium North Car Park with a maximum stay period as requested by the Minister for Education Sport and Culture.
