Road Traffic (St. Helier) (Jersey) Order 1996: Temporary Amendment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Road Traffic (St Helier) (Jersey) Order 1996 – temporary modification, in accordance with Article 68 of the Road Traffic (Jersey) Law 1956 in order to improve unloading facilities outside Sir Walter Raleigh House, Esplanade.

 

Decision(s): The Minister approved the proposal to change the bus stop outside Sir Walter Raleigh House to Parking of Vehicles on Roads for Loading and Unloading.     

Reason(s) for Decision: To improve loading and unloading facilities on the Esplanade.

 

Resource Implications: Jersey Gazette notice - £80. Road marking and signs - £200. Officers time – four hours.

 

Action required: The Minister to instruct his officers to arrange for a notice to be inserted in the Jersey Gazette, as required by Article 68 of the Road Traffic (Jersey) Law 1956.

TRANSPORT AND TECHNICAL SERVICES

 

 TEMPORARY AMENDMENT TO CHANGE A BUS STOP ON THE ESPLANADE TO AN UNLOADING BAY

 

 

Purpose of the Report

 

To make a temporary amendment to the Road Traffic (St Helier) (Jersey) Order 1996.

 

 

Background

 

The Transport and Technical Services Department, after consultation with the Connétable of St Helier, has requested an amendment to the Road Traffic (St Helier) (Jersey) Order 1996, to change the bus stop outside Sir Walter Raleigh House, on the Esplanade, to Parking of Vehicles on Roads for Loading and Unloading.  The amendment can be made under Article 68 of the Road Traffic (Jersey) Law 1956 for a period not exceeding 12 months.

 

Article 68 enables changes to Traffic Orders to be made, for a period of up to 12 months, without waiting for the relatively lengthy process of amending Orders to be completed. During the 12 month period an amendment to the Order will be drafted, for approval by the Minister.

 

 

Discussion

 

This change of use has been agreed with the “Connex” bus company, as this bus stop is no longer necessary due to the close proximity of other bus stops in this area.  An unloading bay in this location is now desirable due to deliveries being made to the new offices being created in the area, and the current tendency for delivery drivers to use the paved area outside “Kingsgate House”.   

 

 

Conclusion

 

Change the bus stop outside Sir Walter Raleigh House, on the Esplanade, from a bus stop to an unloading bay.

 

 

Recommendation

 

The Minister is recommended to approve the attached notice, as required by Article 68 of the Road Traffic (Jersey) Law 1956 to come into effect within seven days after its insertion into the Jersey Gazette.
