A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

Site Description

The equipment is proposed to be located on the exterior of the north east elevation of the existing JEC building. The building is a terminal station for the JEC. The building is enclosed with security fencing.

S/2006/1851 Approval granted in January 2007 for a base station site at Le Mont Mallet, St Martin and for an installation on the St Catherine Pier Lighthouse, St Martin.

Planning Issues

Policy Considerations

In accordance with NR12, telecommunications development will normally be permitted where:

(i) siting and design will not unreasonably affect the character and amenity of the area;

(ii) all practicable possibilities of sharing facilities have been fully explored and found to be unfeasible or unacceptable by the Minister;

(iii) there would be no unacceptable impact on residential amenity;

(iv) the proposal is in accordance with other principles and policies of the Plan. 

Siting and Design

The elevation of the building which the equipment is proposed to be erected is not visible from public view due to the enclosed nature of the JEC compound.  

The equipment proposed is minor which includes a small microwave dish for transmitting data erected on the wall of the building and under the eaves. The impact of this dish will be minimal. The proposal also includes a small cabinet located against the wall of the building and within the security compound of the terminal station. 

A condition is recommended to ensure the colour of the dish and cabinet matches the existing building. 

Site Sharing

The necessity of this site is as a link for the effective operation of the approved site at St Catherine’s Pier Lighthouse. 

Approval was granted in January 2007 for a ground based site at Le Mont Mallet which included a line of sight to St Catherine’s Pier Lighthouse for transmitting data. The site at Le Mont Mallet will not be constructed due to the land owner’s decision, therefore a site must be found on the north east coast to transmit data from St Catherine’s Pier Lighthouse site.  

Other alternative sites were explored but involved the construction of structures. The JEC building is an existing structure that is within the range required. This site was chosen as it was the least visually intrusive and did not involve the construction of additional structures.  

There are no other existing masts along St Catherine’s Bay from the Pier to Le Mont Mallet. Therefore, there are no opportunities to site share within the subject area.  

Residential Amenity

There will be no impact to residential amenity from this installation. The nearest residential property is 60 metres from the JEC building on the opposite elevation to the proposed equipment. There are no other impacts to residential amenity such as traffic, noise, pollution, light, overbearing, overshadowing or overlooking. 

Other Policies of the Plan

The proposal is in accordance with the other policies of the Island Plan.

Conditions

1. The equipment cabinets, dish and all cables, brackets and supports hereby approved shall be painted to match the existing building and permanently maintained in that condition unless otherwise agreed to in writing by the Minister for Planning and Environment. 

2. The permission hereby granted is for a temporary period of 12 months in the first instance. In the event that the Minister for Health and Social Services, during that 12 month period, should change his policy on the safety of telecommunication installations to the effect that they constitute a danger to the public nearby, the Minister for Planning and Environment will review the permission and may require the installation to be removed within a period of 3 months of the Minister for Health and Social Service’s change of policy. Should the Minister for Health and Social Service’s policy not change within 12 months, this permission will have permanent effect.
