Application for Kart racing at Sorel Point 2007

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

The Minister approved the Jersey Kart & Motor Club’s application as constituted in the prepared Order: Road Racing (Karts) (Jersey) Order 2007.

Reason(s) for decision:

The proposed event and road closures being acceptable to the Department and Minister, as the administering authority of the Motor Vehicle Races (Jersey) Law 1946.

Action required:

To send the hard copy of the Order to the Publications Editor at the States Greffe as soon as it has been signed.

Application for Kart racing at Sorel Point 2007

TRANSPORT AND TECHNICAL SERVICES

THE JERSEY KART AND MOTOR CLUB’S APPLICATION FOR KART RACING AT SOREL POINT 2007

Purpose of the Report

To obtain Ministerial Decision regarding approval of the Jersey Kart and Motor Club application to close the Sorel Point Loop Road, St. John, to hold 14 events during 2007, as detailed on the attached schedule.

Background

Following the introduction of the ‘States of Jersey (Transfer of Functions No. 1) (Home Affairs to Transport and Technical Services) (Jersey) Regulations 2006’ the event is now enabled by Order of the Transport and Technical Services Minister under Article 2 of the “Motor Vehicle Races (Jersey) Law 1946.”

Discussion

Since 1999 the Club has used the Sorel Point Loop Road, St. John, to hold its events.

The Jersey Kart and Motor Club are proposing to hold fourteen events this year between 4th March and 21st October. All events will take place, as in previous years, on Sundays between 9.30am and 2.30pm. The only exception is a ‘weekend event’ between 9.30am on Saturday 28th July 2007 and 2.30pm on Sunday 29th July 2007.

Recommendation

The Minister is recommended to approve the Road Racing (Karts) (Jersey) Order 2007 as prepared.

Action Required

Advise the Greffier that the Order has been made and forward the Decision Summary, Report, together with the signed and sealed Order to the Publications Editor at the States Greffe.
