Jersey Car Rally 2010 - Road Closures 8 & 9 October 2010

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister approved the preparation of an Order under Article 2 of the Motor Vehicle Races (Jersey) Law 1946 to enable the Jersey Car Rally 2010.

Reason(s) for Decision: The Minister accepted that the proposed road closures and associated traffic management appeared both reasonable and justified.

TRANSPORT AND TECHNICAL SERVICES  

THE JERSEY MOTOR CYCLE AND LIGHT CAR CLUB’S APPLICATION TO  

HOLD THE JERSEY CAR RALLY 2010  
 

Purpose of the Report   

To obtain a Ministerial Decision regarding approval of road closures and traffic restrictions for the purpose of holding the Jersey Rally on Friday 08 and Saturday 09 October 2010.  

In addition, to enable an instruction to be sent to the Law Draftsman requesting preparation of an Order under Article 2 of the Motor Vehicle Races (Jersey) Law 1946.  

Background  

The Jersey Motor Cycle and Light Car Club (the Promoter) has submitted details of its proposed Paperclix Rally for 2010. The event is enabled by Order of the Minister for Transport and Technical Services under Article 2 of the Motor Vehicle Races (Jersey) Law 1946.  

The Promoter has consulted with the Connétables of all parishes within which stages of the Rally are to be held and has provided TTS with signed certificates of support in each case (excepting St. Brelade). They have also consulted property owners directly affected by road closures and supplied proof of Public Liability Insurance. 
 

Discussion  

Of the various main road sections included in this year’s Rally (see attached Rally Stage Plans & Schedule) all the stages have been utilised in the last two to five years, although there are some minor alterations. Most significant with respect to traffic impact will be the following closures: 

o     La Rue des Mans (B25) and La Route du Francfief (B43) during Stage 1 (between 12.30pm and 5.30 pm on Friday 08 October, although provided there are no delays the road should be opened earlier). During this time access to Les Quennevais will be maintained via Beaumont (A12) and St Aubin’s (A13) Hill;

 

o     Le Mont des Routeurs (B68) and La Rue de la Vallee during Stage 3 (between 6.15pm and 10.45pm on Friday 08 October, with the rest of that route closing earlier at 5.45pm.  During this time access to St Mary’s Village will be maintained via Mont Fallu, La Grande Route de St Pierre and La Grande Route des Augerez etc.;

 

o     Route du Nord and La Rue des Platons during Stages 5 and 6 (between 7.45am and 12.45pm on Saturday 09 October);

 

o     La Rue des Monnieres (B51) during Stage 7 (between 12.45pm and 5.45pm on Saturday 09 October). During this time access to Trinity Village will be maintained via La Grande Route de St Jean and La Route D’Ebenezer etc.;

 

o     Also the Esplanade for the Starting / Finishing Ceremony (at 9.45am on Friday 08 October and again at 6pm on Saturday 09 October for one hour).

 

Otherwise stages have been designed to minimise their impact on traffic.

Recommendation 

The Minister is recommended to approve the Jersey Rally and the preparation of an Order under Article 2 of the of the Motor Vehicle Races (Jersey) Law 1946.
