Meetings with legal representatives (planning practice note)

​Officers of the Department of the Environment, except with express permission from the chief executive, will not meet with applicants or other external parties who have their legal representatives present, unless the officers also have their own legal representation at the meeting.

If an officer arrives at a meeting to find a legal representative present who they were not expecting, they will explain that it is against department policy for the meeting to proceed and either:

  • offer to re-arrange for another date when they can also have a legal representative present
  • offer to progress with the meeting, providing the legal representative leaves

This excludes meetings connected to enforcement matters.
