Notice is hereby given that the Plaintiffs in the above proceedings in the Royal Court of Jersey have filed an application for summary judgment against the First Defendant by way of summons in the following terms:

whereas the Plaintiffs are constrained from communicating with the First Defendant or his legal representatives in Switzerland for the purposes of notifying him of any hearing date by the terms of Article 271(1) of the Swiss Criminal Code
and whereas the Plaintiffs are constrained from serving this summons on the First Defendant or his legal representation in Switzerland by the terms of Article 271(1) of the Swiss Criminal Code
and whereas the terms of Article 141 of the Swiss Civil Procedure Code permits the service of documents by notice in the official gazette of the canton where service would lead to exceptional inconvenience
and whereas section 1140 of the Companies Act (UK) permits the service of documents on directors by sending it by post to the person’s registered address

The Plaintiffs hereby apply for leave under Rule 5/6(1)(d) of the Royal Court Rules and Practice Direction RC 05/10(a) to notify the First Defendant of the Plaintiffs’ application for a date to be fixed for the hearing of this summons and of the date and time at which the Plaintiffs intend to apply no less than 7 days before doing so via the following means:

by publication of a notice in the Jersey Gazette and written communication with Kellerhals Carrard, the legal representative last known to be acting for First Defendant, recommending that the notices page of the Jersey Gazette be kept under review
by registered post to the registered office of Metallon Corporation Limited (in administration) c/o S&W Partners, 45 Gresham Street, London EC2V 7BG
by registered post to the registered office of Great Lakes Telecom Infrastructure Limited at 107 Cheapside, Second Floor, London EC2V 6DN

The Plaintiffs further apply for leave pursuant to Rule 5/6(1)(d) of the Royal Court Rules and Practice Direction RC 05/10(c) to thereafter serve this summons upon the First Defendant by the methods set out at sub-paragraphs 1(a) to (c) above.

Following the above steps:

Let all parties appear before the Royal Court of Jersey on 30 July at 10am to show cause why the following orders should not be made:

that pursuant to Rule 7/1 of the Royal Court Rules summary judgment be entered against the First Defendant in favour of the Plaintiffs in respect of the matters set out in the Order of Justice dated 6 November 2025 on the grounds that the First Defendant has no real prospect of successfully defending the claim and there is no other compelling reason why the case should be disposed of at trial
that the sum of £77,041,670 particularised and claimed in paragraph 44 of the Order of Justice be updated to take account of interest accrued
that payment of the updated sum be made within a period of 28 days
that the First Defendant pay interest upon such sum at the rate of 2% above the Bank of England base rate pursuant to Practice Direction RC 05/06
that the costs of and incidental to the Plaintiffs’ claim against the First Defendant be paid by the First Defendant

The Plaintiffs’ application for summary judgment against the First Defendant will therefore be heard before the Royal Court of Jersey at 10am on 30 July 2026. The affidavits filed in support of the Plaintiffs’ application are being sent to the First Defendant at the registered offices of Metallon Corporation Limited (in administration) and Great Lakes Telecom Infrastructure Limited.
