Income Support (General Provisions) (Amendment No. 23) (Jersey) Order 2019 R&O.36/2019

This Order was made by the Minister for Social Security on Thursday 16 May 2019 and comes into force on Thursday 23 May 2019. This Order amends the Income Support (General Provisions) (Jersey) Order 2008 to specify that persons in an interdependent relationship (defined in new Article 5(4) and (5), to be inserted into the 2008 Order by Article 1(3)(b)) are to be treated as members of the same household for the purposes of eligibility for income support under Article 2 of the Income Support (Jersey) Law 2007.

EU Legislation (Sanctions – Republic of Maldives) (Amendment) (Jersey) Order 2019 R&O.35/2019

This Order was made by the Minister for External Relations on Wednesday 8 May 2019 and came into force on Thursday 9 May 2019. This Order corrects a cross-reference in Article 5(4) of the EU Legislation (Sanctions – Republic of Maldives) (Jersey) Order 2018, which provides that certain offence provisions do not apply to the Minister, or to a delegate of the Minister, when acting as the competent authority.

Taxation (Implementation) (International Tax Compliance) (Common Reporting Standard) (Amendment – Participating Jurisdictions) (Jersey) Order 2019 R&O.34/2019

This Order was made by the Minister for External Relations on Tuesday 7 May 2019 and comes into force on Wednesday 8 May 2019. This Order amends the Taxation (Implementation) (International Tax Compliance) (Common Reporting Standard) (Jersey) Regulations 2015 to make changes to the lists of participating jurisdictions that are covered by the Regulations.

Financial Regulation (Miscellaneous Provisions No. 5) (Jersey) Law 2019 L.7/2019

This Law was registered in the Royal Court on Friday 26 April 2019 and comes into force on Sunday 26 May 2019. This Law amends the Bankruptcy (Désastre) (Jersey) Law 1990 in relation to the persons in respect of which an application for a declaration that the property of a person is en désastre may be made.

This Law also amends various provisions of the Banking Business (Jersey) Law 1991, the Collective Investment Funds (Jersey) Law 1988, the Financial Services (Jersey) Law 1998, the Financial Services Commission (Jersey) Law 1998, the Insurance Business (Jersey) Law 1996 and the Proceeds of Crime (Supervisory Bodies) (Jersey) Law 2008 in relation to limitation of liability; fees, liquidators, record keeping requirements, disclosure of information and penalties.

Finance (2019 Budget) (Jersey) Law 2019 L.6/2019

This Law was registered in the Royal Court on Friday 26 April 2019 and comes into force in accordance with Article 67. The principle purpose of this Law is to give effect to the Budget for 2019, approved by the States on 6th December 2018.

Damages (Jersey) Law 2019 L.5/2019

This Law was registered in the Royal Court on Friday 26 April 2019 and comes into force on Friday 3 May 2019. The Law makes provision for compensation in personal injury cases by requiring courts to apply a specified discount rate to an award of damages and by creating a statutory regime for awarding damages by way of periodical payments.

Cybercrime (Jersey) Law 2019 L.4/2019

This Law was registered in the Royal Court on Friday 26 April 2019 and comes into force on Friday 3 May 2019. The Law makes amendments to criminal legislation to give further effect to the Council of Europe Convention on Cybercrime (Budapest, 2001) and amend the Regulation of Investigatory Powers (Jersey) Law 2005 to provide for the investigation of electronic data protected by encryption.

Emergency Powers and Planning (Designation of Competent Authorities) (Jersey) Act 2019 R&O.33/2019

This Act was made by the Emergencies Council and signed by the Greffier of the States, for and on behalf of the Emergencies Council, on Thursday 10 April 2019 and came into force on being made. Under this Act, the Minister for Economic Development, Tourism, Sport and Culture; the Minster for Home Affairs and the Minister for External Relations, are designated by the Emergencies Council as the competent authorities in relation to port operations, postal services and telecommunications respectively.

Motor Vehicle Registration (General Provisions) (Amendment No. 21) (Jersey) Order 2019 R&O.32/2019

This Order was made by the Minister for Infrastructure on Friday 5 April 2019 and comes into force on Friday 12 April 2019. This Order makes provision for electronic applications for motor vehicle registration and for vehicle registration documents to be issued in electronic form.

Terrorism (Proscribed Organizations) (Amendment No. 11) (Jersey) Order 2019 R&O.31/2019

This Order was made by the Minister for Home Affairs on Thursday 4 April 2019 and came into force on Friday 5 April 2019. This Order amends the list of proscribed organizations in Schedule 1 to the Terrorism (Jersey) Law 2002, to delete 2 entries, add 11 more, and update others.

Control of Housing and Work (Exemptions) (Amendment No. 3) (Jersey) Order 2019 R&O.30/2019

This Order was made by the Chief Minister on Wednesday 3 April 2019 and comes into force on Wednesday 10 April 2019. This Order excludes a person with registered status between the ages of 16 and 26 who is the child of a midwife, nurse or social worker, or who is the child of a co-habiting partner of a person with such an occupation, from being counted for the purpose of determining the maximum number of registered persons who are permitted to work for an undertaking under its business licence.

Sea Fisheries (Bag Limits) (Amendment No. 4) (Jersey) Order 2019 R&O.29/2019

This Order was made by the Minister for the Environment on Thursday 28 March 2019 and came into force on Friday 29 March 2019. This Order amends the Sea Fisheries (Bag Limits) (Jersey) Order 2016 to increase the bag limit set in that Order for the catch of sea bass, to permit one fish per day to be taken during the period 1 April to 31 October inclusive in any particular year. Outside that period, the limit remains at zero.

Sanctions and Asset-Freezing (Transitional Provisions) (Jersey) Regulations 2019 R&O.28/2019

These Regulations were made by the States on Wednesday 27 March 2019 and come into force on the commencement of the Sanctions and Asset-Freezing (Jersey) Law 2019. These Regulations ensure that designations by the United Kingdom under the Terrorist Asset-Freezing etc. Act 2010 and the Policing and Crime Act 2017 will continue to have immediate effect in Jersey when the Sanctions and Asset-Freezing (Jersey) Law 2019 is brought into force.

Restriction on Smoking (Warning Notices) (Amendment for UK Exit from EU) (Jersey) Regulations 2019 R&O.27/2019

These Regulations were made by the States on Tuesday 26 March 2019 and come into force on such day or days, and time or times specified by Order appointed by the Minister for Health and Social Services. These Regulations amend the Restriction on Smoking (Warning Notices) (Jersey) Regulations 2011 to substitute new warning pictures that must be displayed after the United Kingdom’s exit from the European Union.

European Union (United Kingdom Exit – Alternative Investment Funds) (Jersey) Regulations 2019 R&O.26/2019

These Regulations were made by the States on Tuesday 26 March 2019 and come into force on such day or days, and time or times specified by Order appointed by the Minister for External Relations. These Regulations make amendments in relation to alternative investment funds, to reflect the departure of the United Kingdom from the European Union.

European Union (Wines, Spirits, Milk and Dairies – Savings) (Jersey) Regulations 2019 R&O.25/2019

These Regulations were made by the States on Tuesday 26 March 2019 and come into force on such day or days, and time or times specified by Order appointed by the Minister for External Relations. These Regulations amend 2 Orders, one in relation to wines and spirits and the other in relation to milk and dairies, to save the effect of the Orders and of the European Union Regulations underlying them, after Protocol 3 to the United Kingdom’s accession treaty ceases to give direct effect in Jersey to those European Union Regulations.

Taxation (Companies – Economic Substance) (Jersey) Law 2019 L.3/2019

This Law was registered in the Royal Court on Friday 22 March 2019 and came into force on 1 January 2019. This Law makes provision for imposing an economic substance test on certain Jersey companies and for determining whether the test is met by assessing the extent of certain activities carried out in Jersey by such companies and taking appropriate enforcement action where necessary.

Sanctions and Asset-Freezing (Jersey) Law 2019 L.2/2019

This Law was registered in the Royal Court on Friday 22 March 2019 and comes into force on a day specified by the Minister by Order. This Law provides for the freezing of assets of persons subject to international sanctions, and for implementation of EU and UK legislation imposing other sanctions measures.

EU Legislation (Sanctions – Guinea) (Jersey) Order 2019 R&O.24/2019

This Order was made by Minister for External Relations on Wednesday 20 March 2019 and came into force on Thursday 21 March 2019. This Order gives effect in Jersey to Council Regulation (EU) No 1284/2009 of 22 December 2009 imposing certain specific restrictive measures in respect of the Republic of Guinea (OJ L 346, 23.12.2009, p. 26). This Order also replaces the Community Provisions (Restrictive Measures – Guinea) (Jersey) Order 2010 so as to bring the enforcement of the EU Regulation into line with the existing Jersey legislative framework.

Road Traffic (Public Parking Places) (Amendment No. 15) (Jersey) Order 2019 R&O.23/2019

This Order was made by the Minister for Infrastructure on Friday 15 March 2019 and comes into force on Friday 22 March 2019. This Order amends the Road Traffic (Public Parking Places) (Jersey) Order 2006 to add Le Port Car Park to the list of public parking places in St. Peter, with a maximum permitted stay of 12 hours in any continuous period of 24 hours. Long commercial vehicles and agricultural vehicles may be parked in Le Port Car Park without the written permission of the controlling body.

Immigration (Relevant Biometric Information) (Jersey) Regulations 2019 R&O.22/2019

These Regulations were made by the States on Tuesday 12 March 2019 and come into force on Wednesday 13 March 2019. These Regulations provide for an authorised person to require a person to provide a photograph of his or her face for an application for leave to remain in Jersey, in a case in which the Jersey Immigration Rules enable an EU citizen, or family member, to apply for that leave.

European Union (Financial Services – Miscellaneous Amendments) (Jersey) Regulations 2019 R&O.21/2019

These Regulations were made by the States on Tuesday 12 March 2019 and come into force on such day or days, and time or times specified by Order appointed by the Minister for External Relations. These Regulations make miscellaneous amendments to certain financial services Laws having regard to the United Kingdom’s exit from the European Union.

European Union (Amendment – Withdrawal Agreement) (Jersey) Regulations 2019 R&O.20/2019

These Regulations were made by the States on Tuesday 12 March 2019 and come into force on Wednesday 13 March 2019. These Regulations amend the interpretation provision of the European Union (Jersey) Law 1973, to add explanatory material about the meaning of “the arrangements for the Channel Islands set out in the Treaties”  to take account of any withdrawal Agreement between the UK and EU.

European Union (United Kingdom Exit – Animal Health and Welfare) (Jersey) Regulations 2019 R&O.19/2019

These Regulations were made by the States on Tuesday 12 March 2019 and come into force on Wednesday 13 March 2019. These Regulations amend the Animal Health (Jersey) Law 2016, the Animal Welfare (Jersey) Law 2004 and the EU Legislation (Aquatic Animal Health) (Jersey) Regulations 2016, to insert powers for the Minister by Order to make provision related to Brexit and European legislation in those fields until the end of 2020.

Social Security (Miscellaneous Provisions No. 6) (Jersey) Order 2019 R&O.18/2019

This Order was made by the Minister for Social Security on Tuesday 12 March 2019 and comes into force in accordance with Article 6. This Order makes amendments to subordinate legislation which are consequential upon the enactment of the Social Security (Amendment No. 23) (Jersey) Law 2018, which in turn made changes to update provisions relating to long term incapacity allowance, and to introduce consistency across regimes for re-determining claims and questions under the Social Security (Jersey) Law 1974.

EU Legislation (Sanctions – Guinea-Bissau) (Jersey) Order 2019 R&O.17/2019

This Order was made by the Minister for External Relations on Wednesday 6 March 2019 and came into force on Thursday 7 March 2019. This Order gives effect in Jersey to Council Regulation (EU) 377/2012 of 3 May 2012 concerning restrictive measures directed against certain persons, entities, and bodies threatening the peace, security or stability of the Republic of Guinea-Bissau (OJ L 119, 4.5.2012, p. 1.). It replaces a previous Order so that the enforcement of that Regulation is brought into line with the existing Jersey legislative framework.

Air Navigation (Fees) (Amendment) (Jersey) Order 2019 R&O.16/2019

This Order was made by the Minister for External Relations on Wednesday 6 March 2019 and came into force on Thursday 7 March 2019. This Order amends the Air Navigation (Fees) (Jersey) Order 2015 to provide for a fee of £78 to be payable for the grant of permission –

(a)  for an aircraft, registered outside Jersey, the United Kingdom or its Territories and Dependencies, to take on board or discharge any passengers or cargo in Jersey or be flown over Jersey for the purposes of aerial work; and

(b)  for a small unmanned aircraft to be flown for the purpose of aerial work.
