Covid-19 (Safe Distancing – Suspension No. 2) (Jersey) Order 2021 R&O.47/2021

This Order was made by the Minister for Health and Social Services on Friday 9 April 2021 and comes into force on Monday 12 April 2021. This Order is made under Regulation 6(4) of the Covid-19 (Safe Distancing) (Jersey) Regulations 2020, to suspend indefinitely the effect of Regulations 2(2) and 3(1) of those Regulations. The suspended provisions contain the only criminal offences in the Regulations, and the effect of the suspension is that there is no criminal sanction in respect of breaches of safe distancing under the Regulations. The suspension is for an indefinite period, so it lasts until this Order is repealed. But the Regulations themselves are due to expire at the end of 30 April 2021, although P.25/2021 has been lodged to propose extending that date to the end of 31 October 2021. The offences will fall away on the expiry date in any case, whenever that might be.

Covid-19 (Workplace Restrictions and Gathering Control) (Amendment No. 5) (Jersey) Order 2021 R&O.46/2021

This Order was made by the Minister for Health and Social Services on Friday 9 April 2021 and comes into force on Monday 12 April 2021. This Order further relaxes the restrictions imposed by the Covid-19 (Workplace Restrictions) (Jersey) Order 2020 and the Covid-19 (Gathering Control) (Jersey) Order 2020.

Control of Housing and Work (Fees) (Amendment No. 3) (Jersey) Order 2021 R&O.44/2021

This Order was made by the Chief Minister on Thursday 1 April 2021 and comes into force on Thursday 8 April 2021. This Order amends the Control of Housing and Work (Fees) (Jersey) Order 2013  so that the definition “employment agencies” includes businesses which supply persons employed by that business to work for any other business (commonly referred to as “temp agencies”).

Covid-19 (Workplace Restrictions) (Amendment No. 10) (Jersey) Order 2021 R&O.43/2021

This Order was made by the Minister for Health and Social Services on Wednesday 31 March 2021 and comes into force on Friday 2 April 2021. This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020 in relation to food and drink premises, but only in relation to consumption on the premises.
This Order extends to 11 p.m. the time until which the food or drink may be ordered, and to 11.30 p.m. the time by which the food or drink must be consumed. It removes the requirement for customers to be seated at a table while ordering or paying for the food or drink (but retains the seating requirement while consuming the food or drink, and retains the separate limit of 10 customers per table). It removes the requirement for alcoholic drinks to be ordered with a meal. Lastly it broadens the exception from wearing a mask, so that the customer can remove the mask for all of the time spent sitting at the table at which the food or drink is to be consumed.

Covid-19 (Gathering Control – Fifth Extension) (Jersey) Order 2021 R&O.42/2021

This Order was made by the Minister for Health and Social Services on Wednesday 31 March 2021 and comes into force on Thursday 1 April 2021. This Order amends the Covid-19 (Gathering Control) (Jersey) Order 2020, to extend the gathering control period to end at the end of Friday 30 April 2021.

Covid-19 (Workplace – Twenty-First Extension) (Jersey) Order 2021 R&O.41/2021

This Order was made by the Minister for Health and Social Services on Wednesday 31 March 2021 and comes into force on Thursday 1 April 2021. This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020, to extend the restriction period to end at the end of Friday 30 April 2021.

Social Security (Contributions) (Covid‑19) (Amendment No. 3) (Jersey) Order 2021 R&O.40/2021

This Order was made by the Minister for Social Security on Friday 26 March 2021 and comes into force on Tuesday 30 March 2021. This Order amends the Social Security (Contributions) (Covid 19) (Jersey) Order 2020 (the “principal Order”).
This Order amends the principal Order as follows:
(a)  amends Article 1 of the principal Order, to define Quarter A 2021 as the period of 3 months beginning 1st January 2021 and to delete the definition “Department” – all references to “Department” throughout the Order are replaced with “Minister”;
(b)  amends Article 2 of the principal Order, to provide that an employer required to make a Class 1 contribution in respect of Quarter A 2021 may apply to defer payment of those contributions by up to 24 months;
(c)  amends Article 3 of the principal Order, to provide that an insured person required to pay a Class 2 contribution in respect of Quarter A 2021 may apply to defer payment of those contributions by up to 24 months;
(d)  amends Article 4 of the principal Order, to clarify that recovery of a relevant benefit may be made for any relevant benefit paid which is based on a quarter deferred under Article 3 of the principal Order, and that the Minister may seek to recover survivor’s benefit from the survivor of a person who makes a deferral under that Article 3.

Covid-19 (Workplace Restrictions and Gathering Control) (Amendment No. 4) (Jersey) Order 2021 R&O.39/2021

This Order was made by the Minister for Health and Social Services on Thursday 25 March 2021 and comes into force on Friday 26 March 2021. This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020 and the Covid-19 (Gathering Control) (Jersey) Order 2020 to relax the numbers allowed for certain gatherings whilst imposing additional requirements on those gatherings where they take place in workplaces.

Income Tax (Payment of 2019 Liability) (Jersey) Regulations 2021 R&O.38/2021

These Regulations were made by the States on Tuesday 23 March 2021 and come into force on Tuesday 30 March 2021. These Regulations determine when taxpayers, whose 2019 income tax liability has been deferred, must pay that liability. The deferral of the 2019 income tax liability for some taxpayers was a result of the removal of the prior year basis method of paying tax.

Road Traffic (No. 65) (Jersey) Regulations 2021 R&O.37/2021

These Regulations were made by the States on Tuesday 23 March 2021 and come into force on a day to be specified by an Order of the Minister for Infrastructure. These Regulations amend the Road Traffic (Jersey) Law 1956 in respect of driving licences.

Planning and Building (Covid-19 Bridging Island Plan) (Jersey) Order 2021 R&O.36/2021

This Order was made by the Minister for the Environment on Monday 22 March 2021 and comes into force on Tuesday 23 March 2021. This Order provides for the procedures (in particular, the examination in public) relating to the introduction of a relatively short-term, bridging Island Plan in the circumstances created by the Covid-19 emergency and its aftermath.

Road Traffic (St. Martin) (Amendment No. 12) (Jersey) Order 2021 R&O.35/2021

This Order was made by the Minister for Infrastructure on Wednesday 17 March 2021 and comes into force on Wednesday 24 March 2021. This Order amends the Road Traffic (St. Martin) (Jersey) Order 1989 by prohibiting the parking of vehicles in specified parts of La Rue de la Mare des Reines and La Rue des Vaux de L’Eglise in the parish of St. Martin.

Motor Vehicles (Wearing of Seat Belts by Adults) (Amendment No. 2) (Jersey) Order 2021 R&O.34/2021

This Order was made by the Minister for Infrastructure on Wednesday 17 March 2021 and comes into force on Wednesday 24 March 2021. This Order amends the Motor Vehicles (Wearing of Seat Belts by Adults) (Jersey) Order 2009 so as to add a new exemption from wearing seat belts relating to ambulances and to update and broaden the current exemptions relating to the police and fire and rescue services.

Health Insurance Fund (Miscellaneous Provisions) (Amendment No. 2) (Jersey) Law 2021 L.2/2021

This Law was registered in the Royal Court on Friday 12 March 2021 and comes into force on Friday 19 March 2021. The Law amends the Health Insurance Fund (Miscellaneous Provisions) (Jersey) Law 2011 to allow the withdrawal of £11.3 million from the Health Insurance Fund.

Covid-19 (Workplace Restrictions and Gathering Control) (Amendment No. 3) (Jersey) Order 2021 R&O.33/2021

This Order was made by the Minister for Health and Social Services on Friday 12 March 2021 and comes into force on Monday 15 March 2021. This Order makes further amendments to the Covid-19 (Workplace Restrictions) (Jersey) Order 2020 (the “Workplaces Order”) and the Covid-19 (Gathering Control) (Jersey) Order 2020 (the “Gatherings Order”).

The Workplaces Order is amended as follows:
(a)  relocates 2 definitions to the interpretation Article so they can apply to a wider range of Articles;
(b)  amends Article 2 to remove the requirements for amusement centres, certain changing and shower facilities and indoor play areas to be closed and deletes the definitions of “amusement centre” and “indoor play area” which are relocated as mentioned above;
(c)  widens Article 3 to include opening of workplaces subject to conditions. The restrictions on the opening of changing facilities used in connection with swimming pools or paddling pools are removed. Indoor physical activity facilities, swimming pools and paddling pools are now permitted to be open subject to reasonable steps being taken to assist in controlling the spread of Covid-19. Some redundant provisions are also removed;
(d)  amends Article 5 to vary the requirement for visitors to indoor physical activity facilities to wear masks to apply except while in a part of the facility currently being used for sport, dance or exercise. Mask-wearing is now also required in changing facilities (except while actually changing), indoor play areas and amusement centres;
(e)  makes the same changes in relation to the requirements for workers to wear masks or visors in Article 5A as are made in relation to visitors;
(f)  extends the contact-tracing requirements in Article 5B to indoor physical activity facilities (except in the case of certain gatherings of children), indoor play areas and amusement centres;
(g)  widens the 2-metre distancing requirements in Article 5C to cover indoor physical activity facilities in all circumstances, changing or shower facilities and amusement centres. In the case of changing or shower facilities, the requirement doesn’t apply where the occupier or operator of those premises has taken alternative steps to assist in controlling the spread of Covid-19 through the use of screens that shield people from each other.

The Gatherings Order is amended to remove the limit on numbers in relation to gatherings in certain workplaces, namely indoor physical activity facilities, swimming pools and paddling pools, changing and shower facilities and amusement centres. The amendment also removes the requirement for children’s activity groups to have been establishing in December of last year to fall within the exception and increases the numbers allowed in a controlled gathering in the open air by children or adults for sport or exercise from 35 to 45.

Social Security (Television Licence Benefit – Income Threshold) (Jersey) Order 2021 R&O.32/2021

This Order was made by the Minister for Social Security on Friday 12 March 2021 and comes into force on Friday 19 March 2021. This Order sets the income threshold at which a person is eligible for a television licence benefit. It sets the threshold amount for a single person and for a couple.

Covid-19 (Gathering Control) (Amendment No. 4) (Jersey) Order 2021 R&O.31/2021

This Order was made by the Minister for Health and Social Services on Thursday 4 March 2021 and comes into force on Monday 8 March 2021. This Order amends the Covid-19 (Gathering Control) (Jersey) Order 2020 to –
(a)   provide that children under the age of 5 do not count towards the limit of 10 people who may gather in a home (currently only children under the age of 3 do not count);
(b)   introduce a provision that children under the age of 5 do not count towards the limit of 10 people who may gather in the open air;
(c)   provide that children under the age of 5 do not count towards the limit of 10 people who may gather as part of a children’s activity group; and
(d)   enable gatherings of up to 35 people in the open air for the purpose of sport or exercise for adults.

Emergency Powers and Planning (Medicines and Vaccines – Covid-19) (Jersey) Order 2021 R&O.30/2021

This Order was made by the Minister for Health and Social Services on Thursday 4 March 2021 and comes into force on Friday 5 March 2021. This Order is a renewal of the Emergency Powers and Planning (Medicines and Vaccines – Covid-19 and Influenza) (Jersey) Order 2020 (except in relation to influenza) which relaxes controls on medicines to facilitate a plan for vaccination against Covid-19.

States of Jersey (Minister for Children and Education, Minister for Housing and Communities and Minister for External Relations and Financial Services) (Jersey) Order 2021 R&O.29/2021

This Order was made by the Chief Minister on Tuesday 2 March 2021 and came into force forthwith. This Order renames the Minister for Education as the “Minister for Children and Education” and provides for the related transfer of functions relating to children from the current Minister for Children and Housing. The latter Minister is renamed as the “Minister for Housing and Communities”. The Order also renames the Minister for External Relations as the “Minister for External Relations and Financial Services”.

Road Traffic (Periodic Technical Inspections – General Provisions) (Amendment) (Jersey) Order 2021 R&O.28/2021

This Order was made by the Minister for Infrastructure on Friday 26 February 2021 and comes into force on Friday 5 March 2021. This Order amends the Road Traffic (Periodic Technical Inspections – General Provisions) (Jersey) Order 2018 by postponing for 3 years, from 30 March 2021 until 31 March 2024, the date from which vehicles other than minibuses, light motor cycles and mopeds must have their first periodic technical inspections. The scheme introducing mandatory periodic technical inspections for minibuses, light motor cycles and mopeds started on 30 March 2019. For all other vehicles, the date by which the first periodic technical inspection must be made is 5 years after first use and every subsequent 3 years but any such date is disregarded if it falls before 30 March 2021. This Order changes that date to 31 March 2024.

Covid-19 (Gathering Control – Fourth Extension) (Jersey) Order 2021 R&O.27/2021

This Order was made by the Minister for Health and Social Services on Thursday 25 February 2021 and comes into force on Monday 1 March 2021. This Order amends the Covid-19 (Gathering Control) (Jersey) Order 2020, to extend the gathering control period to end at the end of Wednesday 31 March 2021.

Covid-19 (Workplace – Twentieth Extension) (Jersey) Order 2021 R&O.26/2021

This Order was made by the Minister for Health and Social Services on Thursday 25 February 2021 and comes into force on Monday 1 March 2021. This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020, to extend the restriction period to end at the end of Wednesday 31 March 2021.

Prison (Amendment No. 5) (Jersey) Rules 2021 R&O.25/2021

These Rules were made by the Minister for Home Affairs on Tuesday 23 February 2021 and come into force on Tuesday 2 March 2021. These Rules amend the Prison (Jersey) Rules 2007 to allow a unit manager to inquire into a disciplinary charge against a prisoner (currently, only senior unit managers and above can inquire into a charge).

Covid-19 (Workplace Restrictions and Gathering Control) (Amendment No. 2) (Jersey) Order 2021 R&O.24/2021

This Order was made by the Minister for Health and Social Services on Friday 19 February 2021 and came into force on Monday 22 February 2021. This Order further relaxes the restrictions imposed by the Covid-19 (Workplace Restrictions) (Jersey) Order 2020 as follows:
(a)   inserts a definition of “accommodation premises” to cover registered tourism premises (hotels, guest houses, self-catering accommodation, youth hostels and camp sites) and clubs where members can stay;
(b)   removes the restriction on the opening of workplaces used by driving instructors (meaning their vehicles);
(c)   lifts some of the restrictions on the opening of food and drink premises to allow food and drink to be served at tables of up to 10 people till 10 p.m., for premises to be open till 10.30 p.m. and for alcohol to be served if it is ordered at the same time as, or during the consumption of, a meal. In the case of food and drink premises that are also accommodation premises, the time limits do not apply in respect of residents and their guests. Nightclubs are now allowed to be open for the purpose of serving food and drink in accordance with these requirements. Other restrictions applying to licensed premises are removed. Nothing in the whole of Article 3 is to affect any other condition to which a licence is subject;
(d)   limits the requirements for visitors to food and drink premises to wear masks to where the visitor is purchasing or waiting to purchase take-away food or is consuming food or drink on the premises, except while actually eating or drinking. In the case of accommodation premises the visitor must wear a mask in the non-food and drink part of the premises except in the visitor’s own sleeping accommodation. People are also required to wear masks in driving instructors’ vehicles;
(e)   requires workers to wear masks or visors in accommodation premises, and in the case of food premises and accommodation premises, the requirement now applies also while the worker is in the presence of a person working as part of a different workforce to the worker. Driving instructors are also now required to wear masks unless to do so would be unsafe;
(f)   extends the contact tracing requirements to accommodation premises and driving instructors’ vehicles;
(g)   extends the 2 metre distancing requirements to food and drink premises where customers are purchasing or waiting to purchase take-away food or consuming food or drink on the premises. The exceptions are in respect of people who expected to sit at the same table or where the occupier or operator of the premises has deployed screens that shield people from each other. The distancing requirements are also extended to accommodation premises except in the person’s own sleeping accommodation;
(h)   amends the Covid-19 (Gathering Control) (Jersey) Order 2020 to correct a cross-reference and make it clear that the relaxation on gatherings at weddings, funerals and religious services to up to 40 people applies only to the ceremony itself.

Road Traffic (St. Saviour) (Amendment No. 14) (Jersey) Order 2021 R&O.23/2021

This Order was made by the Minister for Infrastructure on Friday 19 February 2021 and comes into force on Saturday 20 February 2021. This Order amends the Road Traffic (St. Saviour) (Jersey) Order 2000 by replacing the current one-way restriction in La Chasse Brunet. That restriction allows traffic to be driven a northerly direction only from the junction with Bagatelle Road to the junction with La Rue de Patier. This Order provides for the one-way restriction to run in the opposite direction, that is, to allow vehicles to be driven only in the direction from the junction with La Rue de Patier to Bagatelle Road.

Education (Grants and Allowances) (Amendment) (Jersey) Order 2021 R&O.22/2021

This Order was made by the Minister for Education on Friday 19 February 2021 and comes into force on Friday 26 February 2021. This Order makes amendments to certain definitions in the interpretation provision of the Education (Grants and Allowances) (Jersey) Order 2018. It also provides for a maximum available grant in respect of a distance learning course, for a maximum duration of a course for which a skills bursary is payable, and adds a further situation in which interview attendance allowance is not payable.

Covid-19 (Gathering Control) (Amendment No. 3) (Jersey) Order 2021 R&O.21/2021

This Order was made by the Minister for Health and Social Services on Tuesday 16 February 2021 and comes into force on Wednesday 17 February 2021. This Order amends the Covid-19 (Gathering Control) (Jersey) Order 2020, following the amendment to that Order made by the Covid-19 (Gathering Control) (Amendment No. 2) (Jersey) Order 2021 (the “Amendment No. 2 Order”). The effect of this amendment is to require a gathering to be in the open air if it is to benefit from the exception for controlled gatherings of up to 35 people for children’s sport or exercise, which was added by the Amendment No. 2 Order.

Covid-19 (Gathering Control) (Amendment No. 2) (Jersey) Order 2021 R&O.20/2021

This Order was made by the Minister for Health and Social Services on Monday 15 February 2021 and comes into force on Wednesday 17 February 2021. This Order amends the current limitations on people gathering that are set out in the Covid-19 (Gathering Control) (Jersey) Order 2020. The effect is to increase the numbers of people who may gather for the celebration of a marriage or civil partnership, at a funeral or part of a service of religious worship from 20 to 40. The Order also allows up to 35 people to gather to enable children to participate in sport or exercise.

Social Security (Contributions) (Covid‑19) (Amendment No. 2) (Jersey) Order 2021 R&O.19/2021

This Order was made by the Minister for Social Security on 7 January 2021 and came into force on 8 January 2021. This Order amends the Social Security (Contributions) (Covid-19) (Jersey) Order 2020 to provide that an employer required to make a Class 1 contribution in respect of the period of 3 months beginning 1 October 2020 (“Quarter D”), or an insured person required to pay a Class 2 contribution in respect of Quarter D, may apply to defer payment of those contributions by up to 24 months. 

Road Traffic (St. Mary) (Amendment No. 3) (Jersey) Order 2021 R&O.18/2021

This Order was made by the Minister for Infrastructure on Friday 12 February 2021 and comes into force on Friday 19 February 2021. This Order amends the Road Traffic (St. Mary) (Jersey) Order 2000 by allowing pedal cycles to be used in both directions along the part of La Rue de la Vallée which is one-way for other vehicles.

Road Traffic (Public Parking Places – Charges) (Amendment No. 5) (Jersey) Order 2021 R&O.17/2021

This Order was made by the Minister for Infrastructure on Friday 12 February 2021 and comes into force on Monday 1 March 2021. This Order increases parking charges in public parking places by a maximum of 1.15%. The parking unit charge is increased except for electric and plug in hybrid electric vehicles. The charges for monthly season tickets are increased, including for electric and plug in hybrid electric vehicles. Excess charges remain unchanged and parking remains free for electric or plug in hybrid electric vehicles for a period of 12 months after first registration in Jersey.

Income Tax (Amendment No. 46) (Jersey) Law 2021 L.1/2021

This Law was registered in the Royal Court on Friday 12 February 2021. Article 8 came into force on 16 November 2020 and the remainder of the Law came into force on 1 January 2021 by Act (R&O.131/2020). The Law amends the Income Tax (Jersey) Law 1961 in order to remove the prior-year basis method of paying income tax.

Covid-19 (Island Plan) (Jersey) Regulations 2021 R&O.16/2021

These Regulations were made by the States on Wednesday 10 February 2021 and come into force on Thursday 11 February 2021. These Regulations amend the Planning and Building (Jersey) Law 2002 to make changes to the process by which the Minister for the Environment lodges policy proposals in respect of the development and use of land in Jersey in the near future. These changes reflect the current uncertainties caused by the Covid-19 pandemic, and are intended to be temporary and finite.

Covid-19 (Workplace Restrictions) (Amendment No. 9) (Jersey) Order 2021 R&O.15/2021

This Order was made by the Minister for Health and Social Services on Tuesday 9 February 2021 and came into force on Wednesday 10 February 2021. This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020 (the “2020 Order”).
The Order amends Article 2 of the 2020 Order to allow:
(a)  allows the opening of workplaces used for the purposes of carrying out:
      (i)  activities undertaken by spas, nail salons, beauty salons, waxing salons or tanning salons, or for laser hair removal,
      (ii)  non-surgical cosmetic procedures such as Botox injections and facial fillers,
      (iii)  tattooing, piercing, acupuncture or massage, or
      (iv)  providing haircuts, hair styling or the professional application of make-up;
(b)  requires changing and shower facilities used in connection with indoor or outdoor sport or exercise to be closed whether those facilities are indoors or outdoors; and
(c)  removes the requirement for swimming and paddling pools to be closed in all circumstances (they are now allowed to be open for limited purposes described below).
The Order amends Article 3 of the 2020 Order to allow:
(a)  changing facilities used in connection with swimming pools or paddling pools to be open but only for the purpose of certain children’s activities;
(b)  swimming pools and paddling pools to be open but only for the same purposes as indoor physical activities facilities are allowed to be open;
(c)  licensed premises to be open additionally for the purposes mentioned in (a)(i) to (iv) as in Article 2; and
(d)  indoor physical activity facilities to be open additionally to allow up to 5 high performing athletes to take part in a physical activity along with up to 2 trainers or others instructing the athletes or assisting them with their training or physical fitness.
The Order also limits the requirement to wear masks in indoor physical activity facilities to where they are required to be worn by visitors, namely when access is incidental to the use of outdoor facilities or in connection with therapeutic services. 

Covid-19 (Workplace Restrictions and Gathering Control) (Amendment) (Jersey) Order 2021 R&O.14/2021

This Order was made by the Minister for Health and Social Services on Monday 1 February 2021 and comes into force on Wednesday 3 February 2021.
This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020 as follows:
(a)  replaces the definition of “indoor recreation facility” so that the restrictions imposed apply only to sport, dance or exercise facilities;
(b)  removes the restrictions on the opening of art galleries, auction houses, betting agencies and shops, and the restriction on the opening of entertainment facilities is now limited to the auditorium of those facilities. A restriction is imposed on the opening of changing and shower facilities used in connection with indoor physical activity facilities or outdoor sport or exercise. The restriction on closing of soft play areas is widened to include all indoor play areas;
(c)  removes the partial restrictions on opening of shops markets and libraries, and visitor attractions, except to the extent closed by other provisions;
(d)  the exceptions to the closure of what are now called indoor physical activity facilities are widened to allow certain gatherings of young people permitted by the Covid-19 (Gathering Control) (Jersey) Order 2020, the provision of certain therapeutic services or for horse riding or exercise in an indoor riding arena, one person at a time. The general exceptions to allow workplaces to be open to allow certain essential services to take place is extended to cover the administering of vaccines against any disease;
(e)  alters the requirement for visitors to certain workplaces to wear masks. In the case of indoor physical activity facilities, it is limited to when access is needed in connection with activities in outdoor areas and where therapeutic services are provided. The requirement is also extended to auction houses and betting agencies;
(f)  updates the requirement for workers to wear masks or visors to the new defined term of “indoor physical activity facilities”. It also requires people working at retail premises to wear masks in the presence of visitors and workers who are part of a different workforce as opposed to in all circumstances (as currently required);
(g)  limits the requirement to maintain at least 2 metres distance from other persons in the case of indoor physical activity facilities to when access is needed in connection with activities in outdoor areas. The requirement is also extended to auction houses and betting agencies.

The Order also amends the Covid-19 (Gathering Control) (Jersey) Order 2020 to include within the exception, to allow gatherings of more than 10 in certain circumstances, before and after school activities.

Covid-19 (Workplace Restrictions) (Amendment No. 8) (Jersey) Order 2021 R&O.13/2021

This Order was made by the Minister for Health and Social Services on Friday 29 January 2021 and comes into force on Saturday 30 January 2021. This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020 to widen the condition of opening that the occupier or operator of the premises requires anyone working there to wear a mask or visor, to apply, in the case of retail premises, irrespective of whether or not the person is in the presence of a visitor.

Immigration (Fees) (Amendment No. 5) (Jersey) Order 2021 R&O.12/2021

This Order was made by the Minister for Home Affairs on Friday 29 January 2021 and comes into force on Sunday 31 January 2021. This Order amends the Immigration (Fees) (Jersey) Order 2017 to make changes to the definition of “dependant” and also adds fees for applications under Appendix HK(J) British National (Overseas) to the Jersey Immigration Rules by people who are, or are connected to, British National (Overseas) citizens ordinarily resident in Hong Kong.

Sanctions and Asset-Freezing (Implementation of External Sanctions) (Jersey) Order 2021 R&O.11/2021

This Order was made by the Minister for External Relations on Friday 29 January 2021 and comes into force on Friday 12 February 2021. This Order repeals and replaces the Sanctions and Asset-Freezing (Implementation of EU Regulations) (Jersey) Order 2020 and the 2 other Orders made under the Sanctions and Asset-Freezing (Jersey) Law 2019. Whereas the EU Order implemented sanctions contained in EU Regulations, this Order implements equivalent sanctions contained in UK Regulations after Brexit (but still implements 4 EU Regulations that have been retained in UK law).

This Order makes amendments to various enactments concerning animal health to take account of the United Kingdom’s exit from the European Union, and to make other miscellaneous changes.

Financial Services Ombudsman (Board – Amendment) (Jersey) Regulations 2021 R&O.7/2021

These Regulations were made by the States on Tuesday 19 January 2021 and come into force on Wednesday 20 January 2021. These Regulations amend the Financial Services Ombudsman (Jersey) Law 2014, which requires the Minister for Economic Development, Tourism, Sport and Culture to appoint members to the board of the Office of the Financial Services Ombudsman. The amendment allows an appointment to be made for one year, but only if it is a re-appointment of a member who has not previously been re-appointed under this power.

Covid-19 (Gathering Control – Second Extension) (Jersey) Order 2021 R&O.6/2021

United Nations Sanctions (Revocations) Order 2020 R&O.4/2021

This Order, which was made by Her Majesty in Council on 16 December 2020, was registered in the Royal Court on Friday 15 January 2021 and came into force on Saturday 16 January 2021. This Order in Council revokes a number of instruments made under the United Nations Act 1946 implementing United Nations sanctions, which are no longer required. 

Covid-19 (Gatherings and Workplace Restrictions – Miscellaneous Amendments) (Jersey) Order 2021 R&O.3/2021

This Order was made by the Minister for Health and Social Services on Friday 15 January 2021 and comes into force on Saturday 16 January 2021. This Order makes various amendments to the Covid-19 (Workplace Restrictions) (Jersey) Order 2020 (“Workplace Restrictions Order”) and the Covid-19 (Gathering Control) (Jersey) Order 2020 (“Gathering Control Order”).
The changes to the Workplace Restrictions Order are as follows:
(a)  adds workplaces used for acupuncture to the list of workplaces that are prohibited from being open to the public;
(b)  creates an exception from the list of workplaces prohibitions, for a workplace that is open for the purpose of a therapeutic service that is provided by a doctor or registered professional;
(c)  alters the condition of opening, for retail and certain other workplaces, that requires people to maintain a 2 metres distance from each other, does not apply between people who are members of the same household;
(d)  it imposes a condition on the opening of a workplace, while it is used for the purpose of a gathering of a children’s activity group, that ensures that the gathering complies with the Gathering Control Order.

The changes to Gathering Control Order are as follows:
(a)  reinstates the higher limit of 20 people for gatherings for marriages, civil partnerships, funerals and religious services;
(b)  replaces the provisions on children’s activity groups and defines a children’s activity group and alters the way the number of people is calculated. It also disapplies the other control requirements if the gathering of the group has no more than 10 people present (who must be the children or the carers of the children) in addition to any number of people who are organising the children’s activities but are not themselves the children or the carers of the children. The group must have been established before 12 December 2020 and it must not gather in a person’s home;
(c)  alters the exception for day care of children, so that it only applies to day carers and accommodation that are registered under the Day Care of Children (Jersey) Law 2002. But a gathering can still be for the purposes of registered day care even if it includes children aged 12 or older (although the registration under that Law only applies in relation to younger children), as long as they are looked after with other children aged 11 or younger.

Plant Health (Phytosanitary Certificates and UK Plant Passports) (Jersey) Order 2020 R&O.188/2020

This Order was made by the Minister for the Environment on Thursday 31 December 2020 and comes into force at 11 p.m. the same day. This Order makes provision for phytosanitary certificates to be used for the movement of plants, plant products and other objects (“plants”) into Jersey from Member States of the European Union, and for UK plant passports to be used for the introduction of plants into Jersey, their movement in Jersey and their movement from Jersey to Great Britain, Guernsey and the Isle of Man.

Sea Fisheries (Licensing of Fishing Boats) (Amendment No. 8) (Jersey) Regulations (Commencement) Order 2020 R&O.187/2020

This Order was made by the Minister for the Environment on Thursday 31 December 2020 and came into force forthwith. This Order makes provision for the Sea Fisheries (Licensing of Fishing Boats) (Amendment No. 8) (Jersey) Regulations 2020 to come into force at 11 p.m. on Thursday 31 December 2020.

Sea Fisheries (Licensing of Fishing Boats) (Amendment No. 8) (Jersey) Regulations 2020 R&O.186/2020

These Regulations were made by the States on Sunday 27 December 2020 and come into force on a day to be specified by the Minister by Order. These Regulations amend the Sea Fisheries (Licensing of Fishing Boats) (Jersey) Regulations 2003 to allow the Minister for the Environment to issue licences to French vessels fishing within the territorial sea of Jersey.

Environment (2021 Fees) (Jersey) Order 2020 R&O.185/2020

This Order was made by the Minister for the Environment on Thursday 24 December 2020 and comes into force on 1 January 2021. This Order increases fees charged under the legislation relating to animals and veterinary matters, planning, plant health, sea fisheries, waste management, water resources and ice-cream vehicles and stalls. The fees have been increased from a year ago by up to 2.5% (subject to rounding). The exceptions are fees under the Endangered Species (CITES) (Fees) (Jersey) Order 2012 which were not increased last year and are increased by 2.5% on the 2019 fees, and the maximum aggregate fee for an application for planning permission for more than one item in the Planning and Building (Fees) (Jersey) Order 2008 which has increased by 31.25%.

Financial Services (Disclosure and Provision of Information) (Jersey) Order 2020 R&O.184/2020

This Order was made by the Minister for External Relations on Wednesday 23 December 2020 and comes into force on 6 January 2021. This Order prescribes the information required to be provided under the Financial Services (Disclosure and Provision of Information) (Jersey) Law 2020 in particular circumstances, and also sets out circumstances in which certain entities are exempt from providing certain information, or where the information to be provided is varied.

Covid-19 (Workplace Restrictions) (Amendment No. 7) (Jersey) Order 2020 R&O.183/2020

This Order was made by the Minister for Health and Social Services on Wednesday 23 December 2020 and comes into force at 6 p.m. on Thursday 24 December 2020. This Order further amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020 in the following terms.
Specifies the workplaces that must be closed to the public completely and those that are permitted to be open for certain purposes only. The workplaces that are completely closed are –
(a) amusement centres;
(b) art galleries;
(c) auction houses and betting agencies;
(d) places doing cosmetic and beauty treatments, tattoo and massage parlours and hairdressers;
(e) jacuzzis, steam rooms, saunas, etc.;
(f) entertainment facilities;
(g) swimming pools;
(h) soft play areas;
(i) workplaces used by registered driving instructors (including vehicles); and
(j) retail premises that are not permitted shops).
The workplaces that are open to the public only for certain purposes are –
(a) food and drink premises for take-away only;
(b) licensed premises other than off-licences and hotels for very limited purposes;
(c) permitted shops for the purpose of selling their usual products;
(d) markets to the extent of allowing food and drink premises and shops as permitted by the Order;
(e) libraries, for the purpose of public access to computers;
(f) indoor facilities for recreation, sport and exercise that are not part of schools, only for limited purposes connected with accessing outdoor areas;
(g) the indoor areas of visitor attractions only for limited purposes connected with accessing outdoor areas.
There are exceptions relating to reasonable access to toilet facilities or to administer appropriate first aid, to provide free services to vulnerable people or to accommodate people who have nowhere else to go, are essential workers or who are accessing a public service.
Extends the requirement for visitors to workplaces to wear masks to take-away food and drink premises, markets, libraries, the indoor facilities for recreation, etc. mentioned above and the indoor areas of visitor attractions.

Nursing Homes (2021 Fees) (Jersey) Order 2020 R&O.182/2020

This Order was made by the Chief Minister on Wednesday 23 December 2020 and comes into force on 1 January 2021. This Order This Order amends the Nursing Homes (General Provisions) (Jersey) Order 1995 to increase, from 1 January 2021, the registration and annual fees set out in that Order by 2.5% in line with Government of Jersey inflation Policy. Those fees were last increased with effect from 1 January 2020.

Covid-19 (Gathering Control) (Amendment) (Jersey) Order 2020 R&O.181/2020

This Order was made by the Minister for Health and Social Services on Tuesday 22 December 2020 and came into force on Wednesday 23 December 2020. This Order amends the Covid-19 (Gathering Control) Order 2020 as follows:

(a)  amends the date when all the gathering control restrictions expire to 6 January 2021.
(b)  limits gatherings of people in the open air to 10 people.
(c)  substitutes new exceptions to the provisions that limit gatherings to 10 people. Controlled gatherings of up to 20 people are allowed at weddings and civil partnership celebrations, funerals and religious services as well as children’s activity groups established before the gathering control restrictions were first introduced. These gatherings must have been arranged before this Order came into force and take place no later than 6 January 2021. A further general exception is allowed for gatherings organised by the Jersey Youth Service.

Covid-19 (Workplace – Sixteenth Extension) (Jersey) Order 2020 R&O.180/2020

This Order was made by the Minister for Health and Social Services on Tuesday 22 December 2020 and comes into force on Thursday 24 December 2020. This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020, to extend the restriction period to end at the end of Wednesday 6 January 2021.

Immigration (Control of Entry Through Republic of Ireland) (Amendment – End of Transition Period) (Jersey) Order 2020 R&O.179/2020

This Order was made by the Minister for Home Affairs on Monday 21 December 2020 and comes into force in accordance with Article 8. This Order amends the Immigration (Control of Entry Through Republic of Ireland) (Jersey) Order 2018 to make provision for the end of the Brexit transition period.

Customs and Excise (Import and Export Control) (Amendment No. 3) (Jersey) Order 2020 R&O.177/2020

This Order was made by the Minister for Home Affairs on Monday 21 December 2020 and comes into force on Monday 28 December 2020. This Order amends the Customs and Excise (Import and Export Control) (Jersey) Order 2006, which specifies goods for which an export licence is required. 

Home Affairs (Fire and Rescue and Petroleum – 2021 Fees) (Jersey) Order 2020 R&O.176/2020

This Order was made by the Minister for Home Affairs on Monday 21 December 2020 and comes into force on 1 January 2021. This Order increases, with effect from 1 January 2021, various fees and charges associated with the Fire and Rescue Service and licensing fees under the Petroleum (Jersey) Law 1984. The fees and charges were last increased on 1 January 2020, and the increases range from 1.8% to 2.5%.

Immigration (EU Withdrawal) (Jersey) Order 2020 L.9/2020

This Order, which was made by Her Majesty in Council Wednesday 16 December 2020, was registered in the Royal Court on Friday 18 December 2020 and comes into force in accordance with article 1(1). This UK Order extends to Jersey, with modifications, Part 1 and sections 7 and 10 of the Immigration and Social Security Co-ordination (EU Withdrawal) Act 2020 of the United Kingdom.

Prison (Amendment No. 4) (Jersey) Rules 2020 R&O.175/2020

These Rules were made by the Minister for Home Affairs on Saturday 19 December 2020 and came into force on Sunday 20 December 2020. These Rules amend the Prison (Jersey) Rules 2007 to extend the application of Rule 63 (which allows the remission of sentences of imprisonment) and Rule 64 (which allows prisoners to be temporarily released) to prisoners in youth detention.

Infrastructure (Driver and Vehicle Standards – 2021 Fees) (Jersey) Order 2020 R&O.174/2020

This Order was made by the Minister for Infrastructure on Friday 18 December 2020 and comes into force on 1 January 2021. This Order increases certain fees charged by Driver and Vehicle Standards from 1 January 2021 by an average of approximately 2.5% (the fee increases being rounded to the nearest pound).

Road Traffic (St. Peter) (Amendment No. 10) (Jersey) Order 2020 R&O.173/2020

This Order was made by the Minister for Infrastructure on Friday 18 December 2020 and comes into force on Friday 25 December 2020. This Order amends the Road Traffic (St. Peter) (Jersey) Order 1992 by (a) prohibiting parking on specified parts of certain roads and (b) creating a counter flow cycle route on the one-way southbound section of La Vallée de Bas.

Road Traffic (St. Saviour) (Amendment No. 13) (Jersey) Order 2020 R&O.172/2020

This Order was made by the Minister for Infrastructure on Friday 18 December 2020 and comes into force on Friday 25 December 2020. This Order amends the Road Traffic (St. Saviour) (Jersey) Order 2000 by creating a one-way traffic route and prohibiting parking in Bagatelle Lane and deleting an obsolete provision relating to Les Varines.

Covid-19 (Workplace Restrictions) (Amendment No. 6) (Jersey) Order 2020 R&O.171/2020

This Order was made by the Minister for Health and Social Services on Friday 18 December 2020 and came into force on Saturday 19 December 2020. This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020, the effect of which –
(a)   closes workplaces (i.e. vehicles) used by registered driving instructors for the purposes of giving driving instruction;
(b)   restricts non-licensed food and drink premises to providing only take-away services; and
(c)   requires occupiers and operators of all food and drink premises to require people on the premises to maintain a distance of at least 2 metres from each other so far as reasonably practicable.

Sanctions and Asset-Freezing (Implementation of EU Regulations) (Amendment – Libya) (Jersey) Order 2020 R&O.170/2020

This Order was made by the Minister for External Relations on Friday 18 December 2020 and came into force on Saturday 19 December 2020. This Order amends the Sanctions and Asset-Freezing (Implementation of EU Regulations) (Jersey) Order 2020 (the “Sanctions Order”) to give effect to a Council Regulation prohibiting the satisfying of claims with regard to contracts and transactions the performance of which was affected by the United Nations Security Council Resolution 883 (1993) and related resolutions.

The amendment renders it an offence under of the Sanctions Order (carrying imprisonment for up to 7 years, an unlimited fine, or both) to contravene or circumvent the prohibition against satisfying those claims. However, under the Sanctions Order, the amendment does not have effect to any extent that it is inconsistent with or repugnant to any provision of the Libya (United Nations Sanctions) (Channel Islands) Order 1993 of the United Kingdom, so long as the latter Order is in force and has effect in the law of Jersey.

The Antarctic Act 1994 (Convention for the Conservation of Antarctic Marine Living Resources) Regulations 2020 R&O.169/2020

These UK Regulations, which were made by the Secretary of State on 6 November 2020, were registered in the Royal Court on Friday 18 December 2020 and come into force in accordance with regulation 1(3).
These Regulations extend to Jersey The Antarctic Act 1994 (Convention for the Conservation of Antarctic Marine Living Resources) Regulations 2020 (S.I.2020/1251) which implements key provisions of the Convention for the Conservation of Antarctic Marine Living Resources.

Covid-19 (Enabling Provisions) (Amendment) (Jersey) Law 2020 L.8/2020

This Law was registered in the Royal Court on Friday 18 December 2020 and came into force on Saturday 19 December 2020. The Law amends the Covid-19 (Enabling Provisions) (Jersey) Law 2020 (the “Law”) which provides that Regulations can be made if they appear to the States to be necessary or expedient as a direct or indirect result of the outbreak of Covid-19 in Jersey or of the aftermath of that outbreak. The amendment extends that to cover the need to prepare for the possibility of one or more subsequent Covid-19 outbreaks (and their aftermaths). The amendment also extends the date of the deadline for making Regulations and Orders under the Law from the end of 2020 to the end of July 2021.

Social Security (Amendment of Law No. 15) (Jersey) Regulations 2020 R&O.168/2020

These Regulations were made by the States on Thursday 17 December 2020 and come into force on Thursday 24 December 2020. These Regulations amend the Social Security (Jersey) Law 1974 to remove the requirement for the States to contribute to the Social Security Fund in 2021.

Act declaring that the Finance (2021 Budget) (Jersey) Law 202- has immediate effect R&O.167/2020

This Act was made by the States on Thursday 17 December 2020 and came into force forthwith. The Act gives immediate effect to the Finance (2021 Budget) (Jersey) Law 202- (P.147/2020), (adopted by the States on Thursday 17 December 2020), as if it were a Law sanctioned by the Privy Council and registered in the Royal Court.

Covid-19 (Gathering Control) (Jersey) Order 2020 R&O.166/2020

This Order was made by the Minister for Health and Social Services on Friday 11 December 2020 and came into force on Saturday 12 December 2020. This Order provides for the control of certain gatherings from 12 December 2020 until the end of Friday 8 January 2021.
This Order –
(a)    restricts participation in a gathering by a person in a home (including in a private garden) that is not the person’s home to no more than 10 people aged 3 or over.
(b)    restricts gatherings in the open air to no more than 20 people, but this does not cover private gardens or workplaces.
(c)    restricts gatherings in workplaces (including construction sites) to no more than 10 people. However, the requirement applies only to visitors and is subject to some exceptions. The exceptions relate to retail premises, banks, public transport, passenger terminals, care homes, adult day care, food and drink premises, courts and tribunals, parish halls to attend public meetings and any workplace used for giving or receiving medical treatment.
(d)    restricts gatherings to no more than 10 people in anywhere that is not a home, in the open air or a workplace or construction site.
(e)    provides for higher numbers to apply in certain circumstances, namely if the gathering is a controlled gathering, and in the case of some funerals. Up to 40 people may gather in the open air or in an outdoor workplace outside the Christmas period, which runs from Wednesday 23 December 2020 to Tuesday 5 January 2021 inclusive.
(f)    creates an exception from any of the above restrictions in the case of gatherings of children for educational purposes or for day care.

Regulation of Care (Fees) (Amendment No. 2) (Jersey) Order 2020 R&O.165/2020

This Order was made by the Minister for the Environment on Friday 11 December 2020 and comes into force on 1 January 2021. This Order makes provision for the fees set out in the Regulation of Care (Fees) (Jersey) Order 2018 to increase, from 1 January 2021, by 2.5%, in line with inflation. Those fees were last increased with effect from 1 January 2020.

Covid-19 (Workplace – Fifteenth Extension) (Jersey) Order 2020 R&O.164/2020

This Order was made by the Minister for Health and Social Services on Wednesday 9 December 2020 and comes into force on Friday 11 December 2020. This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020, to extend the restriction period to end at the end of Wednesday 23 December 2020.

Road Traffic (Speed Limits) (Amendment No. 12) (Jersey) Order 2020 R&O.163/2020

This Order was made by the Minister for Infrastructure on Wednesday 9 December 2020 and comes into force on Monday 14 December 2020. This Order amends the Road Traffic (Speed Limits) (Jersey) Order 2003 by making changes to speed limits in roads in the parish of St. Lawrence and minor changes to speed limits in the parishes of St. Mary, St. Peter and St. Brelade. The main changes made in respect of St. Lawrence are to add further roads to the Schedules limiting the speed limit to 30 or 15 miles per hour.

Emergency Powers and Planning (Medicines and Vaccines – Covid-19 and Influenza) (Jersey) Order 2020 R&O.162/2020

This Order was made by the Minister for Health and Social Services on Friday 4 December 2020 and comes into force on Saturday 5 December 2020. This Order relaxes controls on medicines to facilitate a plan for vaccination against Covid-19 (and for influenza vaccination to support control of Covid-19). If the United Kingdom grants a temporary authorisation for a Covid-19 vaccine (or other medicine in response to the spread of Covid-19), then that temporary authorisation is to be treated as equivalent to a product licence for the purpose of the Medicines (Jersey) Law 1995.

Covid-19 (Workplace Restrictions) (Amendment No. 5) (Jersey) Order 2020 R&O.161/2020

This Order was made by the Minister for Health and Social Services on Thursday 3 December 2020 and comes into force at 10 a.m. on Friday 4 December 2020. This Order further amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020 in the following terms.

Provides for the closure of workplaces (other than schools) that permit people to engage in sport or physical exercise indoors.
Prohibits all licenced premises from being open, except for the selling of take-away food or non-alcoholic drinks, other than –
(a) off-licences;
(b) pubs and other licensed premises entitled to sell alcohol for consumption off the premises limited to doing so;
(c) hotels and other licensed premises offering accommodation providing bed and room service only for the purposes of accommodating people (i) for the remainder of their booking, (ii) if they are directed by the Minister to isolate there or (iii) if they have no other suitable accommodation available to them in Jersey and they are essential workers or it is not practicable for them to leave Jersey.
Requires retail premises and banks to require customers to maintain, as far as practicable, a distance of at least 2 metres apart, or if not practicable and in the case of staff, to take such alternative steps as are reasonable to assist in controlling the spread of Covid-19.

Covid-19 (Safe Distancing – Exception and Revocation of Suspension) (Jersey) Order 2020 R&O.158/2020

This Order was made by the Minister for Health and Social Services on Thursday 3 December 2020 and comes into force on Friday 4 December 2020. This Order is made under the Covid-19 (Safe Distancing) (Jersey) Regulations 2020, the effect of which is currently suspended. This Order ends the suspension, bringing Regulations 2(2) and 3(1) of those Regulations back into force, so that it is again an offence to wilfully fail to comply with a direction from a police officer to cease to breach safe distancing (or a direction to take reasonably practicable steps to secure that a child ceases to breach safe distancing).

Geographical Indications (Jersey) Regulations 2020 R&O.157/2020

These Regulations were made by the States on Thursday 3 December 2020 and come into force on Thursday 10 December 2020. These Regulations provide for the enforcement in Jersey of certain provisions of 4 EU Regulations that recognise geographical indications for goods in the European Union and which the United Kingdom will continue to recognise after it has left the European Union. They would also replace the EU Legislation (Geographical Indications – Wines and Spirits) (Jersey) Order 2016 which made provision for the enforcement of EU legislation recognising geographical indications in respect of wines and spirits.

EU Legislation (Official Controls) (Jersey) Regulations 2020 R&O.156/2020

These Regulations were made by the States on Tuesday 1 December 2020 and come into force on Tuesday 8 December 2020. These Regulations would implement Regulation (EU) 2017/625 of the European Parliament and of the Council on official controls and other official activities performed to ensure the application of food and feed law, rules on animal health and welfare, plant health and plant protection products (the “EU Official Controls Regulation”).

Income Support (Amendment No. 20) (Jersey) Regulations 2020 R&O.155/2020

These Regulations were made by the States on Tuesday 1 December 2020 and come into force on 1 January 2021. These Regulations amend the definition of “social housing” in Regulation 1 of the Income Support (Jersey) Regulations 2007 to include housing provided by the Clos de Paradis Housing Trust. 

EU Legislation (Welfare of Animals during Transport and Pet Travel) (Amendment) (Jersey) Regulations 2020 R&O.154/2020

These Regulations were made by the States on Tuesday 1 December 2020 and come into force when the European Union (Jersey) Law 1973 is repealed. These Regulations make amendments to the Community Provisions (Welfare of Animals during Transport) (Jersey) Regulations 2013 and the Pet Travel Scheme (Jersey) Regulations 2011 to make provision for the United Kingdom leaving the European Union.

Customs and Excise (Export Declarations and Export Controls) (Jersey) Regulations 2020 R&O.153/2020

These Regulations were made by the States on Tuesday 1 December 2020 and come into force on Tuesday 8 December 2020. These Regulations amend the powers in the Customs and Excise (Jersey) Law 1999 dealing with export declarations and controls to allow for provisions to be made following the United Kingdom’s exit from the European Union.

Covid-19 (Workplace Restrictions) (Amendment No. 4) (Jersey) Order 2020 R&O.152/2020

This Order was made by the Minister for Health and Social Services on Monday 30 November 2020 and comes into force at 10 a.m. on Tuesday 1 December 2020. This Order inserts new Articles 5, 5A and 5B in the Covid-19 (Workplace Restrictions) (Jersey) Order 2020 to oblige visitors to certain workplaces to wear masks covering the nose and mouth, and to oblige occupiers or operators of certain workplaces to require their workers to wear a mask or visor and their visitors to give relevant personal data for contact tracing. The types of workplace are different in each case, and there are different exemptions in each case, but children aged under 12 are not obliged to wear masks or visors or to give personal data.

Covid-19 (Workplace – Fourteenth Extension) (Jersey) Order 2020 R&O.151/2020

This Order was made by the Minister for Health and Social Services on Thursday 26 November 2020 and comes into force on Friday 27 November 2020. This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020, to extend the restriction period to end at the end of Thursday 10 December 2020.

Covid-19 (Regulation of Care – Standards and Requirements) (Jersey) Regulations 2020 R&O.150/2020

These Regulations were made by the States on Wednesday 25 November 2020 and come into force on Thursday 26 November 2020. These Regulations make renewed temporary changes to certain requirements in respect of the registration of registered providers, the employment of workers and inspections by the Jersey Health and Social Care Commission in relation to activities regulated under the Regulation of Care regime as a consequence of the outbreak of Covid-19 in Jersey or its aftermath. Earlier temporary changes expired on 30 September 2020.

Covid-19 (Workplace Restrictions) (Amendment) (Jersey) Regulations 2020 R&O.149/2020

These Regulations were made by the States on Tuesday 24 November 2020 and come into force on Wednesday 25 November 2020. These Regulations make amendments to the Covid-19 (Workplace Restrictions) (Jersey) Regulations 2020 to enable a restriction Order made by the Minister for Health and Social Services under the amended Regulations to declare the period during which the Order applies to last for up to 31 days. The Regulations add provision allowing a restriction Order to impose a requirement to wear a mask covering the mouth and nose. That requirement cannot be imposed on a child under the age of 12 or on a person who is in the workplace to work there. It applies only to workplaces (or classes of workplaces) specified in the Order, and must include an exemption related to health or disability. It can include other exemptions and can set the standards for masks and how they are worn. The Regulations expand the factors on which conditions for opening workplaces may be based to include requirements imposed on the occupier or operator of the workplace to do or refrain from doing any action or to impose such a requirement on any other person present at the workplace, and taking any other action that may assist in supressing the spread of Covid-19 in the workplace. They go on to provide that the action that may be taken includes the collection of relevant personal data from anyone present at the workplace.

Covid-19 (Gatherings) (Jersey) Regulations 2020 R&O.148/2020

These Regulations were made by the States on Tuesday 24 November 2020 and come into force on Wednesday 25 November 2020. These Regulations enable the Minister for Health and Social Services to make Orders imposing prohibitions on people, other than children aged under 12, in relation to gatherings of over 10 people. The Regulations do not make it an offence to take part in a gathering in itself, but create an offence of wilfully failing to comply with a direction given by a police officer (or other enforcement officer designated by the Minister) in relation to a gathering control requirement that the person has contravened.

Social Security (Parental Benefit) (Jersey) Order 2020 R&O.147/2020

This Order was made by the Minister for Social Security on Friday 20 November 2020 and comes into force on Tuesday 24 November 2020. This Order repeals and replaces the Social Security (Maternity Benefit) (Jersey) Order 1975 and sets out the requirements for application for a parental grant (formerly a maternity grant or adoptive parent grant) and parental allowance (formerly maternity allowance).

Misuse of Drugs (Licence Fees) (Jersey) Order 2020 R&O.146/2020

This Order was made by the Minister for Health and Social Services on Thursday 19 November 2020 and comes into force on Thursday 26 November 2020. This Order sets out fees to be charged for certain licences issued by the Minister for Health and Social Services under the Misuse of Drugs (General Provisions) (Jersey) Order 2009 and the Misuse of Drugs (Jersey) Law 1978. It also provides that the Minister may waive any fee payable at the Minister’s discretion.

Long-Term Care Services (Health and Social Services Charges) (Amendment No. 8) (Jersey) Order 2020 R&O.145/2020

This Order was made by the Minister for Health and Social Services on Thursday 19 November 2020 and comes into force on Friday 1 January 2021. This Order amends the Long-Term Care Services (Health and Social Services Charges) (Jersey) Order 2014, to increase by approximately 1.1% the charges payable, from 1 January 2021, for the provision of long-term care services to persons aged 18 years or over in a care home or group home.

Covid-19 (Workplace Restrictions) (Amendment No. 3) (Jersey) Order 2020 R&O.144/2020

This Order was made by the Minister for Health and Social Services on Thursday 19 November 2020 and comes into force at 2 a.m. on Friday 20 November 2020. This Order further amends the Covid-19 Workplace Restrictions (Jersey) Order 2020 by imposing further restrictions on opening of food and drink premises that are part of licensed premises (within the meaning of the Licensing (Jersey) Law 1974). The premises may not be open –
(a) for the purpose of selling alcoholic beverages after 10 p.m. on any evening (except as room service to hotel residents); or
(b) to members of the public (not including hotel residents) after 10.30 p.m. on any evening.
This provision does not affect the existing restriction on opening applying to places of entertainment nor any other condition to which a licence issued under the Licensing (Jersey) Law 1974 is subject.

Data Protection (Amendment of Law) (Jersey) Regulations 2020 R&O.143/2020

These Regulations were made by the States on Wednesday 18 November 2020 and come into force on Wednesday 25 November 2020. These Regulations amend Article 1(3A) of the Data Protection (Jersey) Law 2018 so that the United Kingdom is to be treated as not being a third country for the purposes of the Law until the end of 2021 (instead of 2020).

Intellectual Property (Unregistered Rights) (Marrakesh Treaty) (Jersey) Regulations 2020 R&O.141/2020

These Regulations were made by the States on Wednesday 18 November 2020 and come into force on Wednesday 25 November 2020. These Regulations amend the Intellectual Property (Unregistered Rights) (Jersey) Law 2011 to align it with obligations under the Marrakesh Treaty to Facilitate Access to Published Works for Persons Who Are Blind, Visually Impaired or Otherwise Print Disabled.

Limited Partnerships (Annual Additional Charge) (Amendment) (Jersey) Regulations 2020 R&O.140/2020

These Regulations were made by the States on Wednesday 18 November 2020 and come into force on Wednesday 25 November 2020. These Regulations will increase the annual additional amount required to be paid to the Commission under Article 30A(2) of the Limited Partnerships (Jersey) Law 1994 to £145 from £115.

Financial Services (Disclosure and Provision of Information) (Jersey) Law 2020 (Appointed Day) Act 2020 R&O.139/2020

This Act was made by the States on Wednesday 18 November 2020 and came into force forthwith. The Act brings into force the whole of the Financial Services (Disclosure and Provision of Information) (Jersey) Law 2020 on 6 January 2021.

Financial Services (Disclosure and Provision of Information) (Jersey) Regulations 2020 R&O.138/2020

These Regulations were made by the States on Wednesday 18 November 2020 and come into force on 6 January 2021 in accordance with R&O.139/2020. These Regulations set out the information kept in the register under Article 2 of the Financial Services (Disclosure and Provision of Information) (Jersey) Law 2020 which is to be, or may be, made available for public inspection by the Jersey Financial Services Commission; prescribe the fee payable on provision of an annual confirmation statement; and set out the process by which application may be made to the Commission to make information unavailable for public inspection. The Regulations also provide for appeals against decisions of the Commission and make certain consequential amendments.

Social Security (Amendment of Law No. 14) (Jersey) Regulations 2020 R&O.137/2020

These Regulations were made by the States on Tuesday 17 November 2020 and come into force on Tuesday 24 November 2020. These Regulations replace the existing provisions of the Social Security (Jersey) Law 1974 on adoption and maternity benefits, with new provisions creating parental grant and parental allowance. Parental benefits will apply, from 1 January 2021, to all parents who have qualifying levels of social security contributions. The changes made by these Regulations will ensure that the legislation providing for benefits related to the adoption or birth of a child will be, so far as possible, consistent (no matter what the structure of the family concerned) and gender-neutral.

Census (Jersey) Order 2020 R&O.136/2020

This Order was made by the Chief Minister on Monday 16 November 2020 and comes into force on Monday 23 November 2020. This Order makes detailed provision about the mechanics of taking a census.

Long-Term Care (Benefits) (Amendment No. 9) (Jersey) Order 2020 R&O.135/2020

This Order was made by the Minister for Social Security on Friday 6 November 2020 and comes into force on 1 January 2021. This Order amends provisions of the Long-Term Care (Benefits) (Jersey) Order 2014 so as to increase the daily rate for each long-term care benefit comprising standard care costs, and the amount required to be paid towards standard care costs, by 1.1%.

Covid-19 (Workplace – Thirteenth Extension) (Jersey) Order 2020 R&O.134/2020

This Order was made by the Minister for Health and Social Services on Thursday 12 November 2020 and comes into force on Friday 13 November 2020. This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020, to extend the restriction period to end at the end of Thursday 26 November 2020.

Motor Traffic (Cabs – Fares and Charges) (Amendment No. 3) (Jersey) Order 2020 R&O.133/2020

This Order was made by the Minister for Infrastructure on Thursday 5 November and comes into force on Monday 9 November. This Order makes provision for taxi-cab fares and charges to increase by an average of 2.8%. Fares and charges were last increased with effect from 29 July 2019.

Social Security (Amendment of Law No. 13) (Jersey) Regulations 2020 R&O.132/2020

These Regulations were made by the States on Wednesday 4 November 2020 and come into force in accordance with Regulation 5. These Regulations amend the Social Security (Jersey) Law 1974 and the Income Tax (Jersey) Law 1961. The amendments ensure that the collection of long-term care contributions remains consistent with the collection of income tax, given the changes introduced by the Income Tax (Amendment No. 46) (Jersey) Law 202- to remove the prior year basis of paying income tax.

Act declaring that the Income Tax (Amendment No. 46) (Jersey) Law 202- has immediate effect R&O.131/2020

This Act was made by the States on Wednesday 4 November 2020 and came into force forthwith. The Act gives immediate effect to the Income Tax (Amendment No. 46) (Jersey) Law 202- (P.118/2020), (adopted by the States on Wednesday 4 November 2020), as if it were a Law sanctioned by the Privy Council and registered in the Royal Court.

Census (Appointed Day) Act 2020 R&O.130/2020

This Act was made by the States on Wednesday 4 November 2020 and came into force forthwith. The Act appoints 21 March 2021 as the day for holding a Census in Jersey.

Statistics and Census (Amendment of Law) (Jersey) Regulations 2020 R&O.129/2020

These Regulations were made by the States on Wednesday 4 November 2020 and come into force on Wednesday 11 November 2020. These Regulations amend the Schedule to the Statistics and Census (Jersey) Law 2018 to add 2 questions relating to a person’s health and disability to the information required from Jersey residents when taking a census.

EU Legislation (Customs Union, Import and Export Control) (Amendment of Law) (Jersey) Order 2020 R&O.128/2020

This Order was made by the Minister for Home Affairs on Friday 30 October 2020 and comes into force in accordance with Article 2. This Order amends the Customs and Excise (Jersey) Law 1999 to provide a power for fees to be prescribed in relation to functions connected with import duty.

EU Legislation (Customs and Excise – Customs Tariff and Export Duty) (Jersey) Order 2020 R&O.127/2020

This Order was made by the Minister for Home Affairs on Friday 30 October 2020 and comes into force in accordance with Article 4. This Order provides that any legislation that the United Kingdom makes under the Taxation (Cross-border Trade) Act 2018 of the United Kingdom in relation to export duty will apply in Jersey.

Covid-19 (Workplace – Twelfth Extension) (Jersey) Order 2020 R&O.126/2020

This Order was made by the Minister for Health and Social Services on Thursday 29 October 2020 and comes into force on Friday 30 October 2020. This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020, to extend the restriction period to end at the end of Thursday 12 November 2020.

Financial Services (Disclosure and Provision of Information) (Jersey) Law 2020 L.7/2020

This Law was registered in the Royal Court on Friday 23 October 2020 and comes into force on a day to be appointed by Act of the States. The Law requires certain entities to provide the Jersey Financial Services Commission with information relating to the beneficial owners and significant persons of those entities via a nominated person and make other arrangements for the disclosure of certain information to align with recommendations made by the international body known as the Financial Action Task Force.
Road Traffic (Lighting) (Amendment) (Jersey) Order 2020 R&O.125/2020

This Order was made by the Minister for Infrastructure on Monday 19 October 2020 and comes into force on Monday 26 October 2020. This Order amends the Road Traffic (Lighting) (Jersey) Order 1998 to allow pedal cycles to be used with lamps emitting flashing lights and sets out the technical requirements with which such lamps must comply.

Covid-19 (Workplace – Eleventh Extension) (Jersey) Order 2020 R&O.124/2020

This Order was made by the Minister for Health and Social Services on Thursday 15 October 2020 and comes into force on Friday 16 October 2020. This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020, to extend the restriction period to end at the end of Thursday 29 October 2020.

Sanctions and Asset-Freezing (Designation of Lugovoy and Kovtun) (Jersey) Order 2020 R&O.123/2020
This Order was made by the Minister for External Relations on Wednesday 14 October 2020 and comes into force on Thursday 15 October 2020. This Order designates 2 persons for an asset-freeze under Part 3 of the Sanctions and Asset-Freezing (Jersey) Law 2019, using the power in Article 27(2) of that Law to designate persons against whom the United Kingdom has imposed an asset-freeze under section 5 of the Anti-terrorism, Crime and Security Act 2001. The designated persons are Andrey Lugovoy and Dmitri Kovtun, as set out in the Andrey Lugovoy and Dmitri Kovtun Freezing Order 2018 (SI 2018/60) of the United Kingdom.

States of Jersey (Transfer of Responsibilities and Functions) (Regulation of Care) (Jersey) Order 2020 R&O.122/2020

This Order was made by the Chief Minister on Friday 9 October 2020 and comes into force on Friday 16 October 2020. This Order transfers the Chief Minister’s legal responsibilities and functions under the Regulation of Care (Jersey) Law 2014 to the Minister for the Environment.

Sanctions and Asset-Freezing (Implementation of EU Regulations) (Jersey) Order 2020 R&O.121/2020

This Order was made by the Minister for External Relations on Thursday 8 October 2020 and comes into force on Thursday 22 October 2020. This Order implements EU sanctions Regulations in a single Order under the Sanctions and Asset-Freezing (Jersey) Law 2019, to replace all the separate Orders that have been made over time under the European Union Legislation (Implementation) (Jersey) Law 2014 and preserved under the 2019 Law, as well as replacing the 3 separate Orders made so far under the 2019 Law.

Covid-19 (Workplace – Tenth Extension) (Jersey) Order 2020 R&O.119/2020
This Order was made by the Minister for Health and Social Services on Wednesday 30 September 2020 and comes into force on Friday 2 October 2020. This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020, to extend the restriction period to end at the end of Thursday 15 October 2020.

Social Security (Contributions) (Covid-19) (Amendment) (Jersey) Order 2020 R&O.118/2020
This Order was made by the Minister for Social Security on Wednesday 30 September 2020 and comes into force on Thursday 1 October 2020. This Order amends the Social Security (Contributions) (Covid-19) (Jersey) Order 2020 in order to extend from 12 to 24 months, the period by which an employer may apply to defer the payment of Class 1 contributions due for the period between 1 January and 30 June 2020. Secondly, it amends from 12 to 24 months the period by which the Minister may extend the time limit for payment of Class 2 contributions due for the period between 1 January and 30 June 2020. 

Finance (2020 Budget) (Jersey) Law 2020 L.6/2020

This Law was registered in the Royal Court on Friday 25 September 2020 and comes into force in accordance with Article 36. The principle purpose of this Law is to give effect to the Budget for 2020, approved by the States on 2 December 2019.

Licensing (Prescribed Renewal Form) (Jersey) Order 2020 R&O.117/2020

This Order was made by the Minister for Economic Development, Tourism, Sport and Culture on Tuesday 22 September 2020 and comes into force on Tuesday 29 September 2020. This Order prescribes a form for use on a website and an alternative in paper and electronic form for applications to renew a licence under the Licensing (Jersey) Law 1974. The Order also repeals the Licensing (Prescribed Forms) (Jersey) Order 1974, which is replaced in part by this Order. The remainder of the Licensing (Prescribed Forms) (Jersey) Order 1974 is no longer required, as the form of application under Article 3 of the Licensing (Jersey) Law 1974 is now set by the Licensing Assembly, rather than prescribed by the Minister.

Covid-19 (Workplace – Ninth Extension) (Jersey) Order 2020 R&O.116/2020

This Order was made by the Minister for Health and Social Services on Wednesday 16 September 2020 and comes into force on Friday 18 September 2020. This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020, to extend the restriction period to end at the end of Thursday 1 October 2020.

Covid-19 (Amendments – Extension, Suspension and Repeal) (Jersey) Regulations 2020 R&O.115/2020

These Regulations were made by the States on Wednesday 9 September 2020 and come into force on Wednesday 30 September 2020. These Regulations make amendments to several items of legislation that make special provision in relation to Covid-19, most of which are currently due to expire on Wednesday 30 September 2020. The amendments broadly either repeal the legislation, extend its expiry date to the end of April 2021, or suspend its effect but enable that effect to be re-instated by the relevant Minister at any time before the end of April 2021.

Covid-19 (Social Security – Reduction of Contribution Rates) (Jersey) Regulations 2020 R&O.114/2020

These Regulations were made by the States on Wednesday 9 September 2020 and come into force on 1 October 2020. These Regulations, between 1 October 2020 and 30 June 2021, reduce the Class 1 and Class 2 employee contribution rate by 2% below the standard earnings limit provided under Schedules 1A and 1B respectively to the Social Security (Jersey) Law 1974.

Community Costs Bonus (Jersey) Regulations 2020 R&O.113/2020

These Regulations were made by the States on Wednesday 9 September 2020 and came into force on Thursday 10 September 2020. These Regulations create a Community Costs Bonus payable by the Minister for Social Security to households that do not receive income support or pay income tax.

Taxation (Implementation) (International Tax Compliance) (Mandatory Disclosure Rules for CRS Avoidance Arrangements and Opaque Offshore Structures) (Jersey) Regulations 2020 R&O.112/2020

These Regulations were made by the States on Wednesday 9 September 2020 and come into force on such day as the Minister for External Relations may by Order appoint. These Regulations would introduce mandatory disclosure rules (developed by the OECD) which would require promoters, service providers and, in some circumstance, users of Common Reporting Standard (CRS) avoidance arrangements and opaque offshore structures to provide the Comptroller of Revenue with information about those arrangements and structures. Information relating to users resident in other jurisdictions would be exchanged with the tax authority of that jurisdiction in accordance with the terms of the Multilateral Competent Authority Agreement on the automatic exchange regarding CRS avoidance arrangements and opaque offshore structures, ratified by the States on the same day as these Regulations are made.

Planning and Building (General Development) (Amendment No. 6 – Covid-19) (Jersey) Order 2020 R&O.111/2020

This Order was made by the Minister for the Environment on Tuesday 8 September 2020 and comes into force on Wednesday 9 September 2020. This Order amends Part 9 of Schedule 1 to the Planning and Building (General Development) (Jersey) Order 2011. (Part 9 was recently inserted to confer, on the Government of Jersey, general permission for temporary development in respect of emergency medical and related facilities to deal with the Covid-19 pandemic.)
The effect of the amendment is to delete a 6 months’ limitation of time on a change of use of land for such development, allowing the facilities which have been temporarily created to remain in place until May 2021.

Covid-19 (Workplace – Eighth Extension) (Jersey) Order 2020 R&O.110/2020

This Order was made by the Minister for Health and Social Services on Wednesday 2 September 2020 and comes into force on Friday 4 September 2020. This Order amends the Covid-19 (Workplace Restrictions) (Jersey) Order 2020, to extend the restriction period to end at the end of Thursday 17 September 2020.

Comptroller and Auditor General (Board of Governance) (Amendment) (Jersey) Order 2020 R&O.109/2020

This Order was made by the Chief Minister on Friday 28 August 2020 and comes into force on Friday 4 September 2020. This Order amends the Comptroller and Auditor General (Board of Governance) (Jersey) Order 2015 to extend, from 14 September 2020 until the end of 13 March 2021, the end of the term of office of those members of the Board of Governance of the office of Comptroller and Auditor General who were appointed to the Board on 14 September 2016.
