Investigatory Powers (FOI)

Investigatory Powers (FOI)

Authored by States of Jersey and published on 29 December 2016.

Request

Will the Investigatory Powers Act, passed by the United Kingdom House of Commons in 2016 and currently awaiting Royal Assent, be applied to or have its powers extend to the Channel Islands, specifically Jersey?

Alternatively, do the Council of Ministers or the Government of Jersey have any plans to extend the Investigatory Powers Act to Jersey or to put forward a similar act in the States of Jersey?

Response

There is no current work in progress to have this UK legislation enacted in Jersey.

This does not mean, however, that consideration will not be given at some point in the future to have this or similar legislation enacted in Jersey.

Currently, in Jersey, provision is made under the following legislation:

Regulation of Investigatory Powers (Jersey) Law 2005
